66 AN ACT
77 relating to grants awarded to reimburse counties for the cost of
88 monitoring defendants and victims in criminal cases involving
99 family violence.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 772, Government Code, is amended by
1212 adding Section 772.0077 to read as follows:
1313 Sec. 772.0077. GRANT PROGRAM FOR MONITORING DEFENDANTS AND
1414 VICTIMS IN FAMILY VIOLENCE CASES. (a) In this section:
1515 (1) "Criminal justice division" means the criminal
1616 justice division established under Section 772.006.
1717 (2) "Family violence" has the meaning assigned by
1818 Section 71.004, Family Code.
1919 (b) The criminal justice division shall establish and
2020 administer a grant program to reimburse counties for all or part of
2121 the costs incurred by counties as a result of monitoring in cases
2222 involving family violence defendants and victims who participate in
2323 a global positioning monitoring system under Article 17.292 or
2424 17.49, Code of Criminal Procedure. A grant recipient may use funds
2525 from a grant awarded under the program only for monitoring
2626 conducted for the purpose of restoring a measure of security and
2727 safety for a victim of family violence.
2828 (c) The criminal justice division shall establish:
2929 (1) additional eligibility criteria for grant
3030 applicants;
3131 (2) grant application procedures;
3232 (3) guidelines relating to grant amounts;
3333 (4) procedures for evaluating grant applications; and
3434 (5) procedures for monitoring the use of a grant
3535 awarded under the program and ensuring compliance with any
3636 conditions of a grant.
3737 (d) The criminal justice division shall include in the
3838 biennial report required by Section 772.006(a)(9) a detailed
3939 reporting of the results and performance of the grant program
4040 administered under this section.
4141 (e) The criminal justice division may use any revenue
4242 available for purposes of this section.
4343 SECTION 2. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2019.
