| 7 | 7 | | relating to grants awarded to reimburse counties for the cost of |

| 8 | 8 | | monitoring defendants and victims in criminal cases involving |
|---|
| 9 | 9 | | family violence. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 772, Government Code, is amended by |
|---|
| 12 | 12 | | adding Section 772.0077 to read as follows: |
|---|
| 13 | 13 | | Sec. 772.0077. GRANT PROGRAM FOR MONITORING DEFENDANTS AND |
|---|
| 14 | 14 | | VICTIMS IN FAMILY VIOLENCE CASES. (a) In this section: |
|---|
| 15 | 15 | | (1) "Criminal justice division" means the criminal |
|---|
| 16 | 16 | | justice division established under Section 772.006. |
|---|
| 17 | 17 | | (2) "Family violence" has the meaning assigned by |
|---|
| 18 | 18 | | Section 71.004, Family Code. |
|---|
| 19 | 19 | | (b) The criminal justice division shall establish and |
|---|
| 20 | 20 | | administer a grant program to reimburse counties for all or part of |
|---|
| 21 | 21 | | the costs incurred by counties as a result of monitoring in cases |
|---|
| 22 | 22 | | involving family violence defendants and victims who participate in |
|---|
| 23 | 23 | | a global positioning monitoring system under Article 17.292 or |
|---|
| 24 | 24 | | 17.49, Code of Criminal Procedure. A grant recipient may use funds |
|---|
| 25 | 25 | | from a grant awarded under the program only for monitoring |
|---|
| 26 | 26 | | conducted for the purpose of restoring a measure of security and |
|---|
| 27 | 27 | | safety for a victim of family violence. |
|---|
| 28 | 28 | | (c) The criminal justice division shall establish: |
|---|
| 29 | 29 | | (1) additional eligibility criteria for grant |
|---|
| 30 | 30 | | applicants; |
|---|
| 31 | 31 | | (2) grant application procedures; |
|---|
| 32 | 32 | | (3) guidelines relating to grant amounts; |
|---|
| 33 | 33 | | (4) procedures for evaluating grant applications; and |
|---|
| 34 | 34 | | (5) procedures for monitoring the use of a grant |
|---|
| 35 | 35 | | awarded under the program and ensuring compliance with any |
|---|
| 36 | 36 | | conditions of a grant. |
|---|
| 37 | 37 | | (d) The criminal justice division shall include in the |
|---|
| 38 | 38 | | biennial report required by Section 772.006(a)(9) a detailed |
|---|
| 39 | 39 | | reporting of the results and performance of the grant program |
|---|
| 40 | 40 | | administered under this section. |
|---|
| 41 | 41 | | (e) The criminal justice division may use any revenue |
|---|
| 42 | 42 | | available for purposes of this section. |
|---|
| 43 | 43 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 47 | 47 | | Act takes effect September 1, 2019. |
