| 5 | 11 | | relating to certain workers' compensation reporting requirements. |

| 6 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 13 | | SECTION 1. Section 406.145(f), Labor Code, is amended to |
|---|
| 8 | 14 | | read as follows: |
|---|
| 9 | 15 | | (f) If a subsequent hiring agreement is made to which the |
|---|
| 10 | 16 | | joint agreement does not apply, the hiring contractor and |
|---|
| 11 | 17 | | independent contractor shall notify in writing: |
|---|
| 12 | 18 | | (1) [the division and] the hiring contractor's |
|---|
| 13 | 19 | | workers' compensation insurance carrier; and |
|---|
| 14 | 20 | | (2) the division, on the division's request [in |
|---|
| 15 | 21 | | writing]. |
|---|
| 16 | 22 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 17 | 23 | | to a notification required to be provided on or after the effective |
|---|
| 18 | 24 | | date of this Act. |
|---|
| 19 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 20 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 29 | | Act takes effect September 1, 2019. |
