| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 33, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 33.0833 to read as follows: |
|---|
| 12 | 12 | | Sec. 33.0833. ACCESS TO UNIVERSITY INTERSCHOLASTIC LEAGUE |
|---|
| 13 | 13 | | SPONSORED ACTIVITIES FOR STUDENTS UNDER SUPERVISION OF TEXAS |
|---|
| 14 | 14 | | JUVENILE JUSTICE DEPARTMENT. (a) The University Interscholastic |
|---|
| 15 | 15 | | League may provide students receiving educational services under |
|---|
| 16 | 16 | | the supervision of the Texas Juvenile Justice Department with the |
|---|
| 17 | 17 | | opportunity to participate in activities sponsored by the league in |
|---|
| 18 | 18 | | the same manner that the league provides the opportunity to |
|---|
| 19 | 19 | | participate to students enrolled in public schools. Participation |
|---|
| 20 | 20 | | of a public school in an activity in which students receiving |
|---|
| 21 | 21 | | educational services under the supervision of the department |
|---|
| 22 | 22 | | participate is optional. |
|---|
| 23 | 23 | | (b) Before providing students described by Subsection (a) |
|---|
| 24 | 24 | | with the opportunity to participate in activities described by that |
|---|
| 25 | 25 | | subsection, the University Interscholastic League must: |
|---|
| 26 | 26 | | (1) enter into a memorandum of understanding with the |
|---|
| 27 | 27 | | Texas Juvenile Justice Department regarding the policies |
|---|
| 28 | 28 | | governing: |
|---|
| 29 | 29 | | (A) the conditions of eligibility for students |
|---|
| 30 | 30 | | under the supervision of the department in activities sponsored by |
|---|
| 31 | 31 | | the league, including the: |
|---|
| 32 | 32 | | (i) ages of students eligible to |
|---|
| 33 | 33 | | participate; |
|---|
| 34 | 34 | | (ii) academic performance requirements for |
|---|
| 35 | 35 | | students; and |
|---|
| 36 | 36 | | (iii) standards of behavior for students; |
|---|
| 37 | 37 | | (B) the appropriate league in which students |
|---|
| 38 | 38 | | under the supervision of the department will participate; and |
|---|
| 39 | 39 | | (C) the duties of the department regarding other |
|---|
| 40 | 40 | | policies of the league, including fees, insurance, and |
|---|
| 41 | 41 | | transportation; and |
|---|
| 42 | 42 | | (2) adopt rules and administrative guidelines to |
|---|
| 43 | 43 | | implement this section, including procedures allowing for the |
|---|
| 44 | 44 | | optional participation of public schools in the activities provided |
|---|
| 45 | 45 | | to students under the supervision of the department under this |
|---|
| 46 | 46 | | section. |
|---|
| 47 | 47 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 51 | 51 | | Act takes effect September 1, 2019. |
