66 AN ACT
77 relating to the participation of certain students in University
88 Interscholastic League sponsored activities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1111 amended by adding Section 33.0833 to read as follows:
1212 Sec. 33.0833. ACCESS TO UNIVERSITY INTERSCHOLASTIC LEAGUE
1313 SPONSORED ACTIVITIES FOR STUDENTS UNDER SUPERVISION OF TEXAS
1414 JUVENILE JUSTICE DEPARTMENT. (a) The University Interscholastic
1515 League may provide students receiving educational services under
1616 the supervision of the Texas Juvenile Justice Department with the
1717 opportunity to participate in activities sponsored by the league in
1818 the same manner that the league provides the opportunity to
1919 participate to students enrolled in public schools. Participation
2020 of a public school in an activity in which students receiving
2121 educational services under the supervision of the department
2222 participate is optional.
2323 (b) Before providing students described by Subsection (a)
2424 with the opportunity to participate in activities described by that
2525 subsection, the University Interscholastic League must:
2626 (1) enter into a memorandum of understanding with the
2727 Texas Juvenile Justice Department regarding the policies
2828 governing:
2929 (A) the conditions of eligibility for students
3030 under the supervision of the department in activities sponsored by
3131 the league, including the:
3232 (i) ages of students eligible to
3333 participate;
3434 (ii) academic performance requirements for
3535 students; and
3636 (iii) standards of behavior for students;
3737 (B) the appropriate league in which students
3838 under the supervision of the department will participate; and
3939 (C) the duties of the department regarding other
4040 policies of the league, including fees, insurance, and
4141 transportation; and
4242 (2) adopt rules and administrative guidelines to
4343 implement this section, including procedures allowing for the
4444 optional participation of public schools in the activities provided
4545 to students under the supervision of the department under this
4646 section.
4747 SECTION 2. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2019.
