	10	+	AN ACT
4	11		relating to the powers and duties of the Harris County Municipal
5	12		Utility District No. 380; providing authority to issue bonds.
6	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	14		SECTION 1. Subtitle F, Title 6, Special District Local Laws
8	15		Code, is amended by adding Chapter 8035 to read as follows:
9	16		CHAPTER 8035. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 380
10	17		SUBCHAPTER A. GENERAL PROVISIONS
11	18		Sec. 8035.0101. DEFINITION. In this chapter, "district"
12	19		means the Harris County Municipal Utility District No. 380.
13	20		Sec. 8035.0102. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
14	21		(a) The district is created to serve a public purpose and benefit.
15	22		(b) The district is created to accomplish the purposes of:
16	23		(1) a municipal utility district as provided by
17	24		general law and Section 59, Article XVI, Texas Constitution; and
18	25		(2) Section 52, Article III, Texas Constitution, that
19	26		relate to the construction, acquisition, improvement, operation,
20	27		or maintenance of macadamized, graveled, or paved roads, or
21	28		improvements, including storm drainage, in aid of those roads.
22	29		SUBCHAPTER B. POWERS AND DUTIES
23	30		Sec. 8035.0201. AUTHORITY FOR ROAD PROJECTS. Under Section
24	31		52, Article III, Texas Constitution, the district may design,
25	32		acquire, construct, finance, issue bonds for, improve, operate,
26	33		maintain, and convey to this state, a county, or a municipality for
27	34		operation and maintenance macadamized, graveled, or paved roads, or
28	35		improvements, including storm drainage, in aid of those roads.
29	36		Sec. 8035.0202. ROAD STANDARDS AND REQUIREMENTS. (a) A
30	37		road project must meet all applicable construction standards,
31	38		zoning and subdivision requirements, and regulations of each
32	39		municipality in whose corporate limits or extraterritorial
33	40		jurisdiction the road project is located.
34	41		(b) If a road project is not located in the corporate limits
35	42		or extraterritorial jurisdiction of a municipality, the road
36	43		project must meet all applicable construction standards,
37	44		subdivision requirements, and regulations of each county in which
38	45		the road project is located.
39	46		(c) If the state will maintain and operate the road, the
40	47		Texas Transportation Commission must approve the plans and
41	48		specifications of the road project.
42	49		SUBCHAPTER C. BONDS
43	50		Sec. 8035.0301. BONDS FOR ROAD PROJECTS. At the time of
44	51		issuance, the total principal amount of bonds or other obligations
45	52		issued or incurred to finance road projects and payable from ad
46	53		valorem taxes may not exceed one-fourth of the assessed value of the
47	54		real property in the district.
48	55		SECTION 2. (a) The legal notice of the intention to
49	56		introduce this Act, setting forth the general substance of this
50	57		Act, has been published as provided by law, and the notice and a
51	58		copy of this Act have been furnished to all persons, agencies,
52	59		officials, or entities to which they are required to be furnished
53	60		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
54	61		Government Code.
55	62		(b) The governor, one of the required recipients, has
56	63		submitted the notice and Act to the Texas Commission on
57	64		Environmental Quality.
58	65		(c) The Texas Commission on Environmental Quality has filed
59	66		its recommendations relating to this Act with the governor, the
60	67		lieutenant governor, and the speaker of the house of
61	68		representatives within the required time.
62	69		(d) All requirements of the constitution and laws of this
63	70		state and the rules and procedures of the legislature with respect
64	71		to the notice, introduction, and passage of this Act are fulfilled
65	72		and accomplished.
66	73		SECTION 3. This Act takes effect immediately if it receives
67	74		a vote of two-thirds of all the members elected to each house, as
68	75		provided by Section 39, Article III, Texas Constitution. If this
69	76		Act does not receive the vote necessary for immediate effect, this
70	77		Act takes effect September 1, 2019.
