411 relating to the powers and duties of the Harris County Municipal
512 Utility District No. 380; providing authority to issue bonds.
613 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
714 SECTION 1. Subtitle F, Title 6, Special District Local Laws
815 Code, is amended by adding Chapter 8035 to read as follows:
916 CHAPTER 8035. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 380
1017 SUBCHAPTER A. GENERAL PROVISIONS
1118 Sec. 8035.0101. DEFINITION. In this chapter, "district"
1219 means the Harris County Municipal Utility District No. 380.
1320 Sec. 8035.0102. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
1421 (a) The district is created to serve a public purpose and benefit.
1522 (b) The district is created to accomplish the purposes of:
1623 (1) a municipal utility district as provided by
1724 general law and Section 59, Article XVI, Texas Constitution; and
1825 (2) Section 52, Article III, Texas Constitution, that
1926 relate to the construction, acquisition, improvement, operation,
2027 or maintenance of macadamized, graveled, or paved roads, or
2128 improvements, including storm drainage, in aid of those roads.
2229 SUBCHAPTER B. POWERS AND DUTIES
2330 Sec. 8035.0201. AUTHORITY FOR ROAD PROJECTS. Under Section
2431 52, Article III, Texas Constitution, the district may design,
2532 acquire, construct, finance, issue bonds for, improve, operate,
2633 maintain, and convey to this state, a county, or a municipality for
2734 operation and maintenance macadamized, graveled, or paved roads, or
2835 improvements, including storm drainage, in aid of those roads.
2936 Sec. 8035.0202. ROAD STANDARDS AND REQUIREMENTS. (a) A
3037 road project must meet all applicable construction standards,
3138 zoning and subdivision requirements, and regulations of each
3239 municipality in whose corporate limits or extraterritorial
3340 jurisdiction the road project is located.
3441 (b) If a road project is not located in the corporate limits
3542 or extraterritorial jurisdiction of a municipality, the road
3643 project must meet all applicable construction standards,
3744 subdivision requirements, and regulations of each county in which
3845 the road project is located.
3946 (c) If the state will maintain and operate the road, the
4047 Texas Transportation Commission must approve the plans and
4148 specifications of the road project.
4249 SUBCHAPTER C. BONDS
4350 Sec. 8035.0301. BONDS FOR ROAD PROJECTS. At the time of
4451 issuance, the total principal amount of bonds or other obligations
4552 issued or incurred to finance road projects and payable from ad
4653 valorem taxes may not exceed one-fourth of the assessed value of the
4754 real property in the district.
4855 SECTION 2. (a) The legal notice of the intention to
4956 introduce this Act, setting forth the general substance of this
5057 Act, has been published as provided by law, and the notice and a
5158 copy of this Act have been furnished to all persons, agencies,
5259 officials, or entities to which they are required to be furnished
5360 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5461 Government Code.
5562 (b) The governor, one of the required recipients, has
5663 submitted the notice and Act to the Texas Commission on
5764 Environmental Quality.
5865 (c) The Texas Commission on Environmental Quality has filed
5966 its recommendations relating to this Act with the governor, the
6067 lieutenant governor, and the speaker of the house of
6168 representatives within the required time.
6269 (d) All requirements of the constitution and laws of this
6370 state and the rules and procedures of the legislature with respect
6471 to the notice, introduction, and passage of this Act are fulfilled
6572 and accomplished.
6673 SECTION 3. This Act takes effect immediately if it receives
6774 a vote of two-thirds of all the members elected to each house, as
6875 provided by Section 39, Article III, Texas Constitution. If this
6976 Act does not receive the vote necessary for immediate effect, this
7077 Act takes effect September 1, 2019.
