55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring school districts, open-enrollment charter
88 schools, and private schools to adopt and implement policies and
99 procedures relating to the care of students diagnosed with
1010 concussions.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1313 amended by adding Sections 38.034 and 38.035 to read as follows:
1414 Sec. 38.034. RETURN-TO-LEARN POLICIES AND PROCEDURES FOR
1515 STUDENTS DIAGNOSED WITH CONCUSSIONS. (a) Each school district,
1616 open-enrollment charter school, and private school shall adopt and
1717 implement policies and procedures regarding a student's return to
1818 school activities following a concussion diagnosis.
1919 (b) The policies and procedures adopted under Subsection
2020 (a) must:
2121 (1) address the academic needs of a student who has
2222 been diagnosed with a concussion;
2323 (2) establish a return-to-learn protocol, based on
2424 peer-reviewed scientific evidence, for a student's return to
2525 academic course work and activities following a concussion
2626 diagnosis; and
2727 (3) except as provided by Subsection (c), require a
2828 student who has been diagnosed with a concussion to resume all
2929 academic activities without any restrictions or modifications
3030 before:
3131 (A) initiating the return-to-play protocol
3232 established under Section 38.153; or
3333 (B) participating in any physical activity at
3434 school.
3535 (c) A student diagnosed with a concussion must have resumed
3636 all academic activity before:
3737 (1) the return-to-play protocol established under
3838 Section 38.153 is initiated; and
3939 (2) the student may participate in physical activity
4040 at the school.
4141 (d) Each school district, open-enrollment charter school,
4242 and private school shall assign at least one person at each school
4343 campus to oversee compliance with the return-to-learn protocol
4444 established under Subsection (b)(2).
4545 Sec. 38.035. TRAINING AND EDUCATIONAL MATERIALS REGARDING
4646 CONCUSSIONS. (a) Each school district, open-enrollment charter
4747 school, and private school shall adopt a policy requiring each
4848 district or school employee or volunteer who has direct contact
4949 with students to complete not less than two hours of training at
5050 least once every two years regarding concussions.
5151 (b) The training required under Subsection (a) must be
5252 approved by the agency and include information regarding:
5353 (1) how to recognize the signs and symptoms of a
5454 concussion;
5555 (2) the effects of a concussion on a student's academic
5656 abilities;
5757 (3) the importance of communication between a parent
5858 or guardian and educators and health care providers to enable a
5959 student diagnosed with a concussion to successfully resume all
6060 academic activities, including establishing and enforcing academic
6161 restrictions or modifications as needed; and
6262 (4) the development and management of a plan for the
6363 care of a student diagnosed with a concussion as the student resumes
6464 academic activities, including information on:
6565 (A) modifications to learning environments that
6666 may assist a student recovering from a concussion; and
6767 (B) strategies for educators to assist a student
6868 recovering from a concussion to remain current with course work
6969 during the student's recovery.
7070 (c) Each school district, open-enrollment charter school,
7171 and private school may make materials detailing the signs and
7272 symptoms of and course of recovery and treatment for concussions
7373 available to employees, students, and parents or guardians of
7474 students. The materials may be provided in English and Spanish and
7575 in electronic or written form.
7676 SECTION 2. This Act applies beginning with the 2019-2020
7777 school year.
7878 SECTION 3. This Act takes effect immediately if it receives
7979 a vote of two-thirds of all the members elected to each house, as
8080 provided by Section 39, Article III, Texas Constitution. If this
8181 Act does not receive the vote necessary for immediate effect, this
8282 Act takes effect September 1, 2019.
