66 AN ACT
77 relating to the expedited processing of certain applications for
88 permits under the Texas Clean Air Act.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 382.05155(d), (e), and (f), Health and
1111 Safety Code, are amended to read as follows:
1212 (d) The commission by rule may add a surcharge to an
1313 application fee assessed under this chapter for an expedited
1414 application in an amount sufficient to cover the expenses incurred
1515 by the expediting, including overtime, costs of full-time
1616 equivalent commission employees to support the expedited
1717 processing of air permit applications, contract labor, and other
1818 costs. Money from the surcharge collected under this section may be
1919 used to support the expedited processing of air permit applications
2020 under this section.
2121 (e) The commission may authorize the use of overtime,
2222 full-time equivalent commission employees to support the expedited
2323 processing of air permit applications, or contract labor to process
2424 expedited applications. The overtime, full-time equivalent
2525 commission employees, or contract labor authorized under this
2626 section is not included in the calculation of the number of
2727 full-time equivalent commission employees allotted under other
2828 law.
2929 (f) The commission may pay for compensatory time, overtime,
3030 full-time equivalent commission employees supporting the expedited
3131 processing of air permit applications, or contract labor used to
3232 implement this section. The commission is authorized to set the
3333 rate for overtime compensation for full-time equivalent commission
3434 employees supporting the expedited processing of air permit
3535 applications.
3636 SECTION 2. This Act takes effect September 1, 2019.
