55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to discussing with a patient the risks of certain
88 controlled substance prescriptions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 481.0764, Health and Safety Code, is
1111 amended by adding Subsections (f) and (g) to read as follows:
1212 (f) A prescriber, other than a veterinarian, on issuance of
1313 the initial prescription for a Schedule II controlled substance or
1414 an opioid, shall discuss with the patient and, if the patient is a
1515 minor, the patient's parent, conservator, or guardian, or other
1616 person authorized to consent to the minor's medical treatment:
1717 (1) the risk of addiction associated with the drug
1818 prescribed, including any risk of developing a physical or
1919 psychological dependence on the drug;
2020 (2) the risk of overdose associated with the drug
2121 prescribed; and
2222 (3) the danger of taking the drug with
2323 benzodiazepines, alcohol, or other central nervous system
2424 depressants.
2525 (g) A prescriber who discusses the risks of a controlled
2626 substance prescription under Subsection (f) shall note the
2727 discussion in the patient's medical record.
2828 SECTION 2. The change in law made by this Act applies only
2929 to a prescription issued on or after the effective date of this Act.
3030 A prescription issued before the effective date of this Act is
3131 governed by the law in effect on the date the prescription is
3232 issued, and the former law is continued in effect for that purpose.
3333 SECTION 3. This Act takes effect September 1, 2019.
