66 AN ACT
77 relating to the expansion of the Texas Innovative Adult Career
88 Education (ACE) Grant Program to include certain nonprofit
99 organizations providing job training to veterans.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 136.001, Education Code, is amended by
1212 adding Subdivision (5) to read as follows:
1313 (5) "Veteran" means a person who has served in:
1414 (A) the army, navy, air force, coast guard, or
1515 marine corps of the United States;
1616 (B) the state military forces as defined by
1717 Section 431.001, Government Code; or
1818 (C) an auxiliary service of one of those branches
1919 of the armed forces.
2020 SECTION 2. Section 136.005, Education Code, is amended to
2121 read as follows:
2222 Sec. 136.005. TEXAS INNOVATIVE ADULT CAREER EDUCATION (ACE)
2323 GRANT PROGRAM. (a) The grant administrator shall establish and
2424 administer the Texas Innovative Adult Career Education (ACE) Grant
2525 Program to provide grants to:
2626 (1) eligible nonprofit workforce intermediary and job
2727 training organizations; and
2828 (2) eligible nonprofit organizations providing job
2929 training to veterans.
3030 (a-1) In awarding grants under the program, the grant
3131 administrator shall take into consideration the recommendations of
3232 the program advisory board.
3333 (b) Grants may be awarded under this chapter from the Texas
3434 Innovative Adult Career Education (ACE) Grant fund only to develop,
3535 support, or expand programs of eligible nonprofit workforce
3636 intermediary and job training organizations and of eligible
3737 nonprofit organizations providing job training to veterans to
3838 prepare low-income students or veterans, as applicable, to enter
3939 careers in high-demand and significantly higher-earning
4040 occupations.
4141 SECTION 3. Section 136.006, Education Code, is amended by
4242 adding Subsection (a-1) and amending Subsection (b) to read as
4343 follows:
4444 (a-1) To be eligible for a grant under the program, a
4545 nonprofit organization providing job training services to veterans
4646 must:
4747 (1) apply to the grant administrator in the manner
4848 prescribed by the grant administrator;
4949 (2) provide to veterans:
5050 (A) job training; and
5151 (B) a continuum of services designed to move a
5252 program participant from application to employment, including
5353 outreach, assessment, case management, support services, and
5454 career placement;
5555 (3) be governed by a board or other governing
5656 structure that includes recognized leaders of broad-based
5757 community organizations and executive-level or managerial-level
5858 members of the local business community;
5959 (4) demonstrate to the satisfaction of the program
6060 advisory board that the organization's program has achieved or will
6161 achieve the following measure of success among program
6262 participants:
6363 (A) rapid attainment of civilian workforce
6464 credentials; and
6565 (B) entry into careers with significantly higher
6666 earnings for program participants than previously achieved; and
6767 (5) provide matching funds in accordance with rules
6868 adopted under this chapter.
6969 (b) The matching funds required under Subsection (a)(5) or
7070 (a-1)(5) may be obtained from any source available to the
7171 organization, including in-kind contributions, community or
7272 foundation grants, individual contributions, and local
7373 governmental agency operating funds. The grant administrator may
7474 adopt rules requiring an organization to demonstrate compliance
7575 with the matching funds requirement before the payment of the next
7676 installment under an awarded grant.
7777 SECTION 4. This Act takes effect September 1, 2019.
