911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. The heading to Section 259.002, Health and
1113 Safety Code, is amended to read as follows:
1214 Sec. 259.002. REQUIREMENTS FOR PRACTICING SURGICAL
1315 TECHNOLOGY; CONTINUING EDUCATION.
1416 SECTION 2. Section 259.002, Health and Safety Code, is
1517 amended by adding Subsections (d), (e), and (f) to read as follows:
1618 (d) A person employed by a health care facility to practice
1719 surgical technology under Subsection (a)(1) shall complete the
1820 number of hours of continuing education required to maintain
1921 certification by the organization that issued the surgical
2022 technologist certification to the person. On the facility's
2123 request, the person shall submit to the facility evidence of
2224 completion of the continuing education.
2325 (e) A person employed by a health care facility to practice
2426 surgical technology under Subsection (a)(2) or (3) or Subsection
2527 (c) shall complete every two years 30 hours of continuing education
2628 related to surgical technology. On the facility's request, the
2729 person shall submit to the facility evidence of completion of the
2830 continuing education.
2931 (f) A health care facility may restrict the ability of a
3032 person employed by the facility to practice surgical technology in
3133 the facility if the person fails to complete the continuing
3234 education required by Subsection (d) or (e).
3335 SECTION 3. Notwithstanding Sections 259.002(d) and (e),
3436 Health and Safety Code, as added by this Act, a person employed by a
3537 health care facility to practice surgical technology is not
3638 required to complete the continuing education before September 1,
3739 2020.
3840 SECTION 4. This Act takes effect September 1, 2019.
