5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to the inspection period for a motor vehicle; increasing
8	8	certain fees.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 382.0622(a), Health and Safety Code, is
11	11	amended to read as follows:
12	12	(a) Clean Air Act fees consist of:
13	13	(1) fees collected by the commission under Sections
14	14	382.062, 382.0621, 382.202, and 382.302 and as otherwise provided
15	15	by law;
16	16	(2) $4 [$2] from the portion of each fee collected for
17	17	inspections of vehicles other than mopeds and remitted to the state
18	18	under Section [Sections] 548.501 [and 548.503], Transportation
19	19	Code; and
20	20	(3) fees collected that are required under Section 185
21	21	of the federal Clean Air Act (42 U.S.C. Section 7511d).
22	22	SECTION 2. Section 548.051, Transportation Code, is amended
23	23	to read as follows:
24	24	Sec. 548.051. VEHICLES AND EQUIPMENT SUBJECT TO REGULAR
25	25	INSPECTION. (a) A motor vehicle, trailer, semitrailer, pole
26	26	trailer, or mobile home, registered in this state, must have the
27	27	following items inspected biennially at an inspection station or by
28	28	an inspector:
29	29	(1) tires;
30	30	(2) wheel assembly;
31	31	(3) safety guards or flaps, if required by Section
32	32	547.606;
33	33	(4) brake system, including power brake unit;
34	34	(5) steering system, including power steering;
35	35	(6) lighting equipment;
36	36	(7) horns and warning devices;
37	37	(8) mirrors;
38	38	(9) windshield wipers;
39	39	(10) sunscreening devices, unless the vehicle is
40	40	exempt from sunscreen device restrictions under Section 547.613;
41	41	(11) front seat belts in vehicles on which seat belt
42	42	anchorages were part of the manufacturer's original equipment;
43	43	(12) exhaust system;
44	44	(13) exhaust emission system;
45	45	(14) fuel tank cap, using pressurized testing
46	46	equipment approved by department rule; and
47	47	(15) emissions control equipment as designated by
48	48	department rule.
49	49	(b) A moped is subject to inspection in the same manner as a
50	50	motorcycle, except that:
51	51	(1) the only items of equipment required to be
52	52	inspected are the brakes, headlamps, rear lamps, and reflectors,
53	53	which must comply with the standards prescribed by Sections 547.408
54	54	and 547.801; and
55	55	(2) a moped must be inspected annually.
56	56	SECTION 3. The heading to Subchapter C, Chapter 548,
57	57	Transportation Code, is amended to read as follows:
58	58	SUBCHAPTER C. [PERIODS OF INSPECTION;] PREREQUISITES TO ISSUANCE
59	59	OF PASSING VEHICLE INSPECTION REPORT
60	60	SECTION 4. Section 548.103, Transportation Code, is
61	61	transferred to Subchapter E, Chapter 548, Transportation Code,
62	62	redesignated as Section 548.2571, Transportation Code, and amended
63	63	to read as follows:
64	64	Sec. 548.2571 [548.103]. EXTENDED INSPECTION PERIOD FOR
65	65	CERTAIN VEHICLES. The department may extend the time within which
66	66	the resident owner of a vehicle that is not in this state when an
67	67	inspection is required must have the [obtain a] vehicle inspected
68	68	[inspection report in this state].
69	69	SECTION 5. Section 548.254, Transportation Code, is amended
70	70	to read as follows:
71	71	Sec. 548.254. VALIDITY OF VEHICLE INSPECTION REPORT. The
72	72	department, and the conservation commission if necessary, by rule
73	73	shall establish the length of time a [A] vehicle inspection report
74	74	required by this chapter is valid [invalid after the end of the 12th
75	75	month following the month in which the report is issued].
76	76	SECTION 6. Subchapter E, Chapter 548, Transportation Code,
77	77	is amended by adding Section 548.257 to read as follows:
78	78	Sec. 548.257. TIMING OF INSPECTION FOR REGISTRATION-BASED
79	79	ENFORCEMENT. The department shall require a vehicle required to be
80	80	inspected under this chapter to pass the required inspection:
81	81	(1) for initial registration, not earlier than 90 days
82	82	before the date of registration;
83	83	(2) for a renewal of registration, not earlier than 90
84	84	days before the date of expiration of the vehicle's registration;
85	85	(3) if the vehicle is a used motor vehicle sold by a
86	86	dealer, as defined by Section 503.001, in the 180 days preceding the
87	87	date the dealer sells the vehicle; or
88	88	(4) if the vehicle is subject to the federal motor
89	89	carrier safety regulations, in a period that complies with those
90	90	regulations.
91	91	SECTION 7. Sections 548.501(a) and (b), Transportation
92	92	Code, are amended to read as follows:
93	93	(a) Except as provided by Section [Sections 548.503 and]
94	94	548.504, the fee for inspection of a [motor] vehicle under Section
95	95	548.051(a) [other than a moped] is $18.50 [$12.50]. The fee for
96	96	inspection of a moped under Section 548.051(b) is $5.75.
97	97	(b) Out of each fee for an inspection of a vehicle other than
98	98	a moped, $11.50 [$5.50] shall be remitted to the state under Section
99	99	548.509. Out of each fee for an inspection of a moped, $5.50 shall
100	100	be remitted to the state under Section 548.509.
101	101	SECTION 8. Section 548.502, Transportation Code, is amended
102	102	to read as follows:
103	103	Sec. 548.502. INSPECTION BY POLITICAL SUBDIVISION OR STATE
104	104	AGENCY. A political subdivision or state agency for which the
105	105	department certifies an inspection station under Section 548.004:
106	106	(1) shall pay to the state $11.50 [$5.50] for each
107	107	inspection under Section 548.051(a) [548.509]; and
108	108	(2) may not be required to pay the remainder of the
109	109	inspection fee.
110	110	SECTION 9. Section 548.505(a), Transportation Code, is
111	111	amended to read as follows:
112	112	(a) The department by rule may impose an inspection fee for
113	113	a vehicle inspected under Section 548.301(a) in addition to the fee
114	114	provided by Section 548.501, 548.502, [548.503,] or 548.504. A fee
115	115	imposed under this subsection must be based on the costs of:
116	116	(1) providing inspections; and
117	117	(2) administering the program.
118	118	SECTION 10. Sections 548.101, 548.102, and 548.503,
119	119	Transportation Code, are repealed.
120	120	SECTION 11. This Act takes effect September 1, 2019.
