55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the inspection period for a motor vehicle; increasing
88 certain fees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 382.0622(a), Health and Safety Code, is
1111 amended to read as follows:
1212 (a) Clean Air Act fees consist of:
1313 (1) fees collected by the commission under Sections
1414 382.062, 382.0621, 382.202, and 382.302 and as otherwise provided
1515 by law;
1616 (2) $4 [$2] from the portion of each fee collected for
1717 inspections of vehicles other than mopeds and remitted to the state
1818 under Section [Sections] 548.501 [and 548.503], Transportation
1919 Code; and
2020 (3) fees collected that are required under Section 185
2121 of the federal Clean Air Act (42 U.S.C. Section 7511d).
2222 SECTION 2. Section 548.051, Transportation Code, is amended
2323 to read as follows:
2424 Sec. 548.051. VEHICLES AND EQUIPMENT SUBJECT TO REGULAR
2525 INSPECTION. (a) A motor vehicle, trailer, semitrailer, pole
2626 trailer, or mobile home, registered in this state, must have the
2727 following items inspected biennially at an inspection station or by
2828 an inspector:
2929 (1) tires;
3030 (2) wheel assembly;
3131 (3) safety guards or flaps, if required by Section
3232 547.606;
3333 (4) brake system, including power brake unit;
3434 (5) steering system, including power steering;
3535 (6) lighting equipment;
3636 (7) horns and warning devices;
3737 (8) mirrors;
3838 (9) windshield wipers;
3939 (10) sunscreening devices, unless the vehicle is
4040 exempt from sunscreen device restrictions under Section 547.613;
4141 (11) front seat belts in vehicles on which seat belt
4242 anchorages were part of the manufacturer's original equipment;
4343 (12) exhaust system;
4444 (13) exhaust emission system;
4545 (14) fuel tank cap, using pressurized testing
4646 equipment approved by department rule; and
4747 (15) emissions control equipment as designated by
4848 department rule.
4949 (b) A moped is subject to inspection in the same manner as a
5050 motorcycle, except that:
5151 (1) the only items of equipment required to be
5252 inspected are the brakes, headlamps, rear lamps, and reflectors,
5353 which must comply with the standards prescribed by Sections 547.408
5454 and 547.801; and
5555 (2) a moped must be inspected annually.
5656 SECTION 3. The heading to Subchapter C, Chapter 548,
5757 Transportation Code, is amended to read as follows:
5858 SUBCHAPTER C. [PERIODS OF INSPECTION;] PREREQUISITES TO ISSUANCE
5959 OF PASSING VEHICLE INSPECTION REPORT
6060 SECTION 4. Section 548.103, Transportation Code, is
6161 transferred to Subchapter E, Chapter 548, Transportation Code,
6262 redesignated as Section 548.2571, Transportation Code, and amended
6363 to read as follows:
6464 Sec. 548.2571 [548.103]. EXTENDED INSPECTION PERIOD FOR
6565 CERTAIN VEHICLES. The department may extend the time within which
6666 the resident owner of a vehicle that is not in this state when an
6767 inspection is required must have the [obtain a] vehicle inspected
6868 [inspection report in this state].
6969 SECTION 5. Section 548.254, Transportation Code, is amended
7070 to read as follows:
7171 Sec. 548.254. VALIDITY OF VEHICLE INSPECTION REPORT. The
7272 department, and the conservation commission if necessary, by rule
7373 shall establish the length of time a [A] vehicle inspection report
7474 required by this chapter is valid [invalid after the end of the 12th
7575 month following the month in which the report is issued].
7676 SECTION 6. Subchapter E, Chapter 548, Transportation Code,
7777 is amended by adding Section 548.257 to read as follows:
7878 Sec. 548.257. TIMING OF INSPECTION FOR REGISTRATION-BASED
7979 ENFORCEMENT. The department shall require a vehicle required to be
8080 inspected under this chapter to pass the required inspection:
8181 (1) for initial registration, not earlier than 90 days
8282 before the date of registration;
8383 (2) for a renewal of registration, not earlier than 90
8484 days before the date of expiration of the vehicle's registration;
8585 (3) if the vehicle is a used motor vehicle sold by a
8686 dealer, as defined by Section 503.001, in the 180 days preceding the
8787 date the dealer sells the vehicle; or
8888 (4) if the vehicle is subject to the federal motor
8989 carrier safety regulations, in a period that complies with those
9090 regulations.
9191 SECTION 7. Sections 548.501(a) and (b), Transportation
9292 Code, are amended to read as follows:
9393 (a) Except as provided by Section [Sections 548.503 and]
9494 548.504, the fee for inspection of a [motor] vehicle under Section
9595 548.051(a) [other than a moped] is $18.50 [$12.50]. The fee for
9696 inspection of a moped under Section 548.051(b) is $5.75.
9797 (b) Out of each fee for an inspection of a vehicle other than
9898 a moped, $11.50 [$5.50] shall be remitted to the state under Section
9999 548.509. Out of each fee for an inspection of a moped, $5.50 shall
100100 be remitted to the state under Section 548.509.
101101 SECTION 8. Section 548.502, Transportation Code, is amended
102102 to read as follows:
103103 Sec. 548.502. INSPECTION BY POLITICAL SUBDIVISION OR STATE
104104 AGENCY. A political subdivision or state agency for which the
105105 department certifies an inspection station under Section 548.004:
106106 (1) shall pay to the state $11.50 [$5.50] for each
107107 inspection under Section 548.051(a) [548.509]; and
108108 (2) may not be required to pay the remainder of the
109109 inspection fee.
110110 SECTION 9. Section 548.505(a), Transportation Code, is
111111 amended to read as follows:
112112 (a) The department by rule may impose an inspection fee for
113113 a vehicle inspected under Section 548.301(a) in addition to the fee
114114 provided by Section 548.501, 548.502, [548.503,] or 548.504. A fee
115115 imposed under this subsection must be based on the costs of:
116116 (1) providing inspections; and
117117 (2) administering the program.
118118 SECTION 10. Sections 548.101, 548.102, and 548.503,
119119 Transportation Code, are repealed.
120120 SECTION 11. This Act takes effect September 1, 2019.
