| 7 | 7 | | relating to the early release from supervision of certain persons |

| 8 | 8 | | released on parole or to mandatory supervision. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 508.1555(a), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (a) A parole officer annually shall identify the releasees |
|---|
| 13 | 13 | | under the parole officer's supervision who are eligible for early |
|---|
| 14 | 14 | | release from supervision under Section 508.155(c). A releasee is |
|---|
| 15 | 15 | | eligible for early release if: |
|---|
| 16 | 16 | | (1) the releasee has been under supervision for the |
|---|
| 17 | 17 | | lesser of: |
|---|
| 18 | 18 | | (A) [at least] one-half of the time that remained |
|---|
| 19 | 19 | | on the releasee's sentence when the releasee was released from |
|---|
| 20 | 20 | | imprisonment; or |
|---|
| 21 | 21 | | (B) 10 years; |
|---|
| 22 | 22 | | (2) during the preceding two-year period, the releasee |
|---|
| 23 | 23 | | has not committed any violation of the rules or conditions of |
|---|
| 24 | 24 | | release; |
|---|
| 25 | 25 | | (3) during the period of supervision the releasee's |
|---|
| 26 | 26 | | parole or release to mandatory supervision has not been revoked; |
|---|
| 27 | 27 | | and |
|---|
| 28 | 28 | | (4) the division determines: |
|---|
| 29 | 29 | | (A) that the releasee has made a good faith |
|---|
| 30 | 30 | | effort to comply with any restitution order imposed on the releasee |
|---|
| 31 | 31 | | by a court; and |
|---|
| 32 | 32 | | (B) that allowing the releasee to serve the |
|---|
| 33 | 33 | | remainder of the releasee's sentence without supervision and |
|---|
| 34 | 34 | | reporting is in the best interest of society. |
|---|
| 35 | 35 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 36 | 36 | | person on parole or mandatory supervision on or after the effective |
|---|
| 37 | 37 | | date of this Act, regardless of whether the person was released on |
|---|
| 38 | 38 | | parole or to mandatory supervision before, on, or after that date. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2019. |
