55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the early release from supervision of certain persons
88 released on parole or to mandatory supervision.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 508.1555(a), Government Code, is amended
1111 to read as follows:
1212 (a) A parole officer annually shall identify the releasees
1313 under the parole officer's supervision who are eligible for early
1414 release from supervision under Section 508.155(c). A releasee is
1515 eligible for early release if:
1616 (1) the releasee has been under supervision for the
1717 lesser of:
1818 (A) [at least] one-half of the time that remained
1919 on the releasee's sentence when the releasee was released from
2020 imprisonment; or
2121 (B) 10 years;
2222 (2) during the preceding two-year period, the releasee
2323 has not committed any violation of the rules or conditions of
2424 release;
2525 (3) during the period of supervision the releasee's
2626 parole or release to mandatory supervision has not been revoked;
2727 and
2828 (4) the division determines:
2929 (A) that the releasee has made a good faith
3030 effort to comply with any restitution order imposed on the releasee
3131 by a court; and
3232 (B) that allowing the releasee to serve the
3333 remainder of the releasee's sentence without supervision and
3434 reporting is in the best interest of society.
3535 SECTION 2. The change in law made by this Act applies to a
3636 person on parole or mandatory supervision on or after the effective
3737 date of this Act, regardless of whether the person was released on
3838 parole or to mandatory supervision before, on, or after that date.
3939 SECTION 3. This Act takes effect September 1, 2019.
