55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to creating a school safety allotment under the foundation
88 school program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.108, Education Code, is amended by
1111 adding Subsection (b-1) to read as follows:
1212 (b-1) In a school district's safety and security audit
1313 required under Subsection (b), the district must certify that the
1414 district used the funds provided to the district through the school
1515 safety allotment under Section 42.168 only for the purposes
1616 provided by that section.
1717 SECTION 2. Subchapter C, Chapter 42, Education Code, is
1818 amended by adding Section 42.168 to read as follows:
1919 Sec. 42.168. SCHOOL SAFETY ALLOTMENT. (a) A school
2020 district is entitled to an annual allotment of $50, or a greater
2121 amount provided by appropriation, for each student in average daily
2222 attendance.
2323 (b) Funds allocated under this section must be used to
2424 improve school safety and security, including costs associated
2525 with:
2626 (1) securing school facilities, including:
2727 (A) improvements to school infrastructure;
2828 (B) the use or installation of physical barriers;
2929 and
3030 (C) the purchase and maintenance of security
3131 cameras or other security equipment;
3232 (2) providing security for the district, including:
3333 (A) employing school district peace officers,
3434 private security officers, and school marshals; and
3535 (B) collaborating with local law enforcement
3636 agencies, such as entering into a memorandum of understanding for
3737 the assignment of school resource officers to schools in the
3838 district; and
3939 (3) school safety and security training and planning,
4040 including:
4141 (A) active shooter and emergency response
4242 training; and
4343 (B) prevention and treatment programs relating
4444 to addressing adverse childhood experiences.
4545 (c) A school district that is required to take action under
4646 Chapter 41 to reduce its wealth per student to the equalized wealth
4747 level is entitled to a credit, in the amount of the allotments to
4848 which the district is entitled under this section, against the
4949 total amount required under Section 41.093 for the district to
5050 purchase attendance credits.
5151 (d) The commissioner may adopt rules to implement this
5252 section.
5353 SECTION 3. This Act takes effect September 1, 2019.
