| 5 | 12 | | relating to the authority of an insured to select a pharmacist under |

| 6 | 13 | | the insured's health insurance policy. |

| 7 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 15 | | SECTION 1. Section 1451.001, Insurance Code, is amended by |
|---|
| 9 | 16 | | adding Subdivision (13-a) to read as follows: |
|---|
| 10 | 17 | | (13-a) "Pharmacist" means an individual licensed to |
|---|
| 11 | 18 | | practice pharmacy by the Texas State Board of Pharmacy. |
|---|
| 12 | 19 | | SECTION 2. Subchapter C, Chapter 1451, Insurance Code, is |
|---|
| 13 | 20 | | amended by adding Section 1451.128 to read as follows: |
|---|
| 14 | 21 | | Sec. 1451.128. SELECTION OF PHARMACIST. An insured may |
|---|
| 15 | 22 | | select a pharmacist to provide the services scheduled in the health |
|---|
| 16 | 23 | | insurance policy that are within the scope of the pharmacist's |
|---|
| 17 | 24 | | license to practice pharmacy under Subtitle J, Title 3, Occupations |
|---|
| 18 | 25 | | Code. |
|---|
| 19 | 26 | | SECTION 3. Section 1451.128, Insurance Code, as added by |
|---|
| 20 | 27 | | this Act, applies only to an insurance policy delivered, issued for |
|---|
| 21 | 28 | | delivery, or renewed on or after January 1, 2020. An insurance |
|---|
| 22 | 29 | | policy delivered, issued for delivery, or renewed before January 1, |
|---|
| 23 | 30 | | 2020, is governed by the law as it existed immediately before the |
|---|
| 24 | 31 | | effective date of this Act, and that law is continued in effect for |
|---|
| 25 | 32 | | that purpose. |

| 26 | 33 | | SECTION 4. This Act takes effect September 1, 2019. |
