66 AN ACT
77 relating to a grant program and interagency review of resources to
88 support and sustain recovery community organizations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.02253 to read as follows:
1212 Sec. 531.02253. RECOVERY COMMUNITY ORGANIZATION GRANT
1313 PROGRAM. (a) In this section, "recovery community organization"
1414 means a nonprofit organization that:
1515 (1) mobilizes resources inside and outside of a local
1616 community to increase the prevalence and quality of long-term
1717 recovery for persons with substance use disorder and their family
1818 members; and
1919 (2) is wholly or partly governed by members of the
2020 local community:
2121 (A) at least 40 percent of whom identify as a
2222 person recovering from a substance use disorder; and
2323 (B) at least 40 percent of whom identify as an
2424 affected family member of a person recovering from a substance use
2525 disorder.
2626 (b) The commission shall develop and operate a grant program
2727 to award grants to recovery community organizations to:
2828 (1) establish a network of five recovery community
2929 organizations in geographical areas throughout this state to
3030 provide services in one or more counties with populations of not
3131 more than 100,000; and
3232 (2) assist each recovery community organization
3333 described by Subdivision (1) in developing:
3434 (A) a structure of governance that aligns with
3535 national best practice standards for substance use recovery
3636 services; and
3737 (B) a strategic plan to identify:
3838 (i) available resources within a community
3939 served by the recovery community organization;
4040 (ii) the prioritized needs of a community
4141 served by the recovery community organization;
4242 (iii) recovery support solutions; and
4343 (iv) short- and long-term goals for the
4444 sustained operation of the recovery community organization and the
4545 recovery of persons within a community served by the organization.
4646 (c) The commission may provide a grant under Subsection (b)
4747 only in accordance with a contract between the commission and the
4848 recovery community organization. The contract must include
4949 provisions under which the commission is granted sufficient control
5050 to ensure the public purpose of substance use recovery is
5151 accomplished and the state receives the return benefit.
5252 (d) In addition to money appropriated by the legislature,
5353 the commission may solicit and accept gifts, grants, or donations
5454 from any source to administer or finance the grant program
5555 established under this section.
5656 SECTION 2. (a) In this section, "recovery community
5757 organization" has the meaning assigned by Section 531.02253,
5858 Government Code, as added by this Act.
5959 (b) Each of the following state agencies shall identify
6060 available resources under the state agency's control that may be
6161 used to support and sustain recovery community organizations
6262 throughout this state:
6363 (1) the Health and Human Services Commission;
6464 (2) the Department of State Health Services;
6565 (3) the Department of Family and Protective Services;
6666 (4) the Texas Education Agency;
6767 (5) the Department of Agriculture;
6868 (6) the Texas Department of Housing and Community
6969 Affairs;
7070 (7) the Texas Department of Criminal Justice;
7171 (8) the Texas Juvenile Justice Department;
7272 (9) the Texas Veterans Commission; and
7373 (10) the Texas A&M AgriLife Extension Service.
7474 (c) Not later than September 1, 2020, each state agency
7575 described by Subsection (b) of this section shall prepare and
7676 submit to the legislature a written report that outlines the
7777 available resources identified by the state agency under Subsection
7878 (b).
7979 SECTION 3. As soon as practicable after the effective date
8080 of this Act, the executive commissioner of the Health and Human
8181 Services Commission shall adopt rules as necessary to implement
8282 Section 531.02253, Government Code, as added by this Act.
8383 SECTION 4. This Act takes effect September 1, 2019.
