| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Article 42.03, Code of Criminal Procedure, is |

| 11 | 11 | | amended by adding Section 2-a to read as follows: |
|---|
| 12 | 12 | | Sec. 2-a. In addition to the credit given to a defendant |
|---|
| 13 | 13 | | under Section 2, the judge of the court in which the defendant is |
|---|
| 14 | 14 | | convicted may give the defendant credit on the defendant's sentence |
|---|
| 15 | 15 | | for any time the defendant was confined in jail or prison for |
|---|
| 16 | 16 | | another case only, if that confinement occurred after the |
|---|
| 17 | 17 | | commission of the offense for which the defendant is convicted and |
|---|
| 18 | 18 | | before the date of the defendant's sentencing. |

| 19 | 19 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 20 | 20 | | defendant who is sentenced for an offense on or after the effective |
|---|
| 21 | 21 | | date of this Act, regardless of whether the offense is committed |
|---|
| 22 | 22 | | before, on, or after the effective date of this Act. |

| 23 | 23 | | SECTION 3. This Act takes effect September 1, 2019. |
