55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility of the children of public school
88 educators for free prekindergarten programs in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 29.153(b) and (f), Education Code, are
1111 amended to read as follows:
1212 (b) A child is eligible for enrollment in a prekindergarten
1313 class under this section if the child is at least three years of age
1414 and:
1515 (1) is unable to speak and comprehend the English
1616 language;
1717 (2) is educationally disadvantaged;
1818 (3) is a homeless child, as defined by 42 U.S.C.
1919 Section 11434a, regardless of the residence of the child, of either
2020 parent of the child, or of the child's guardian or other person
2121 having lawful control of the child;
2222 (4) is the child of an active duty member of the armed
2323 forces of the United States, including the state military forces or
2424 a reserve component of the armed forces, who is ordered to active
2525 duty by proper authority;
2626 (5) is the child of a member of the armed forces of the
2727 United States, including the state military forces or a reserve
2828 component of the armed forces, who was injured or killed while
2929 serving on active duty;
3030 (6) is or ever has been in the conservatorship of the
3131 Department of Family and Protective Services following an adversary
3232 hearing held as provided by Section 262.201, Family Code; [or]
3333 (7) is the child of a person eligible for the Star of
3434 Texas Award as:
3535 (A) a peace officer under Section 3106.002,
3636 Government Code;
3737 (B) a firefighter under Section 3106.003,
3838 Government Code; or
3939 (C) an emergency medical first responder under
4040 Section 3106.004, Government Code; or
4141 (8) is the child of an educator employed by a school
4242 district in this state.
4343 (f) A child who is eligible for enrollment in a
4444 prekindergarten class under Subsection (b)(4), [or] (5), or (8)
4545 remains eligible for enrollment after the child begins a
4646 prekindergarten class if, as applicable, the child's parent:
4747 (1) leaves the armed forces;
4848 (2) [, or] is no longer on active duty; or
4949 (3) is no longer employed as an educator by a school
5050 district in this state[, after the child begins a prekindergarten
5151 class].
5252 SECTION 2. This Act applies beginning with the 2019-2020
5353 school year.
5454 SECTION 3. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2019.
