A BILL TO BE ENTITLED
AN ACT
relating to the location of hearings relating to contested cases
before the Texas Commission on Environmental Quality.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 2003.047, Government Code, is amended by
adding Subsection (d-1) to read as follows:
(d-1) A contested case hearing under this section shall be
conducted in the house district in which the facility or proposed
facility for which the permit or permit amendment under
consideration in the contested case hearing is located.
SECTION 2. The change in law made by this Act does not apply
to a contested case hearing conducted by the State Office of
Administrative Hearings under Section 2003.047, Government Code,
as amended by this Act, for which the location of the hearing was
determined before the effective date of this Act.
SECTION 3. This Act takes effect September 1, 2019.
