8 | 8 | | in establishing the rates of electric and gas utilities. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter B, Chapter 36, Utilities Code, is |
---|
11 | 11 | | amended by adding Section 36.066 to read as follows: |
---|
12 | 12 | | Sec. 36.066. CONSIDERATION OF COMPENSATION AND BENEFIT |
---|
13 | 13 | | EXPENSES. (a) In this section, "employee compensation and |
---|
14 | 14 | | benefits" includes base salaries, wages, incentive compensation, |
---|
15 | 15 | | and benefits. The term does not include pension and other |
---|
16 | 16 | | postemployment benefits. |
---|
17 | 17 | | (b) When establishing an electric utility's rates, the |
---|
18 | 18 | | regulatory authority shall presume that employee compensation and |
---|
19 | 19 | | benefits expenses are reasonable and necessary if the expenses are |
---|
20 | 20 | | consistent with recent market compensation studies. |
---|
21 | 21 | | SECTION 2. Subchapter B, Chapter 104, Utilities Code, is |

22 | 22 | | amended by adding Section 104.060 to read as follows: |

32 | 32 | | SECTION 3. (a) Sections 36.066 and 104.060, Utilities Code, |
---|
33 | 33 | | as added by this Act, apply only to a proceeding for the |
---|
34 | 34 | | establishment of rates for which the regulatory authority has not |
---|
35 | 35 | | issued a final order or decision before the effective date of this |
---|
36 | 36 | | Act. |
---|
37 | 37 | | (b) A proceeding for which the regulatory authority has |
---|
38 | 38 | | issued a final order or decision before the effective date of this |
---|
39 | 39 | | Act is governed by the law in effect immediately before that date, |
---|
40 | 40 | | and that law is continued in effect for that purpose. |
---|
41 | 41 | | SECTION 4. This Act takes effect immediately if it receives |
---|
42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
---|
43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
---|
45 | 45 | | Act takes effect September 1, 2019. |
