66 AN ACT
77 relating to the consideration of employee compensation and benefits
88 in establishing the rates of electric and gas utilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 36, Utilities Code, is
1111 amended by adding Section 36.066 to read as follows:
1212 Sec. 36.066. CONSIDERATION OF COMPENSATION AND BENEFIT
1313 EXPENSES. (a) In this section, "employee compensation and
1414 benefits" includes base salaries, wages, incentive compensation,
1515 and benefits. The term does not include pension and other
1616 postemployment benefits.
1717 (b) When establishing an electric utility's rates, the
1818 regulatory authority shall presume that employee compensation and
1919 benefits expenses are reasonable and necessary if the expenses are
2020 consistent with recent market compensation studies.
2121 SECTION 2. Subchapter B, Chapter 104, Utilities Code, is
2222 amended by adding Section 104.060 to read as follows:
2323 Sec. 104.060. CONSIDERATION OF COMPENSATION AND BENEFIT
2424 EXPENSES. (a) In this section, "employee compensation and
2525 benefits" includes base salaries, wages, incentive compensation,
2626 and benefits. The term does not include pension and other
2727 postemployment benefits.
2828 (b) When establishing a gas utility's rates, the regulatory
2929 authority shall presume that employee compensation and benefits
3030 expenses are reasonable and necessary if the expenses are
3131 consistent with recent market compensation studies.
3232 SECTION 3. (a) Sections 36.066 and 104.060, Utilities Code,
3333 as added by this Act, apply only to a proceeding for the
3434 establishment of rates for which the regulatory authority has not
3535 issued a final order or decision before the effective date of this
3636 Act.
3737 (b) A proceeding for which the regulatory authority has
3838 issued a final order or decision before the effective date of this
3939 Act is governed by the law in effect immediately before that date,
4040 and that law is continued in effect for that purpose.
4141 SECTION 4. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2019.
