411 AN ACT
512 relating to the creation of a statewide alert system for certain
613 missing adults and to a study of the alert system.
714 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
815 SECTION 1. Chapter 411, Government Code, is amended by
916 adding Subchapter Q to read as follows:
1017 SUBCHAPTER Q. ALERT FOR MISSING ADULTS
1118 Sec. 411.461. DEFINITIONS. In this subchapter:
1219 (1) "Adult" means a person who is 18 years of age or
1320 older but younger than 65 years of age.
1421 (2) "Alert" means the statewide alert for missing
1522 adults that is developed and implemented under this subchapter.
1623 (3) "Bodily injury" has the meaning assigned by
1724 Section 1.07, Penal Code.
1825 (4) "Local law enforcement agency" means a local law
1926 enforcement agency with jurisdiction over the investigation of a
2027 missing adult.
2128 Sec. 411.462. ALERT FOR MISSING ADULTS. With the
2229 cooperation of the Texas Department of Transportation, the office
2330 of the governor, and other appropriate law enforcement agencies in
2431 this state, the department shall develop and implement a system to
2532 allow a statewide alert to be activated on behalf of a missing
2633 adult.
2734 Sec. 411.463. ADMINISTRATION. (a) The director is the
2835 statewide coordinator of the alert system.
2936 (b) The director shall adopt rules and issue directives as
3037 necessary to ensure proper implementation of the alert system. The
3138 rules and directives must include:
3239 (1) the procedures to be used by a local law
3340 enforcement agency to verify whether an adult is missing and
3441 whether circumstances indicate that:
3542 (A) the missing adult is in imminent danger of
3643 bodily injury or death; or
3744 (B) the disappearance of the missing adult may
3845 not have been voluntary, including cases of abduction or
3946 kidnapping;
4047 (2) a description of the circumstances under which a
4148 local law enforcement agency is required to report a missing adult
4249 to the department; and
4350 (3) the procedures to be used by an individual or
4451 entity to report information about a missing adult to designated
4552 media outlets in this state.
4653 (c) The director shall prescribe forms for use by local law
4754 enforcement agencies in requesting activation of the alert system.
4855 Sec. 411.464. DEPARTMENT TO RECRUIT PARTICIPANTS. The
4956 department shall recruit public and commercial television and radio
5057 broadcasters, private commercial entities, state or local
5158 governmental entities, the public, and other appropriate persons to
5259 assist in developing and implementing the alert system.
5360 Sec. 411.465. STATE AGENCIES. (a) A state agency
5461 participating in the alert system shall:
5562 (1) cooperate with the department and assist in
5663 developing and implementing the alert system; and
5764 (2) establish a plan for providing relevant
5865 information to its officers, investigators, or employees, as
5966 appropriate, once the alert system has been activated.
6067 (b) In addition to its duties as a state agency under
6168 Subsection (a), the Texas Department of Transportation shall
6269 establish a plan for providing relevant information to the public
6370 through an existing system of dynamic message signs located across
6471 the state.
6572 Sec. 411.466. NOTIFICATION TO DEPARTMENT OF MISSING ADULT.
6673 (a) A local law enforcement agency shall notify the department if
6774 the agency:
6875 (1) receives a report regarding a missing adult;
6976 (2) verifies that at the time the adult is reported
7077 missing:
7178 (A) the person reported missing is 18 years of
7279 age or older but younger than 65 years of age;
7380 (B) the adult's location is unknown; and
7481 (C) the adult has been missing for less than 72
7582 hours;
7683 (3) confirms that a preliminary investigation has
7784 taken place with respect to the disappearance and that, as a result
7885 of that investigation, the agency believes that the adult is
7986 missing under circumstances described by Section 411.463(b)(1)(A)
8087 or (B); and
8188 (4) believes sufficient information is available to
8289 disseminate to the public that could assist in locating the adult, a
8390 person suspected of abducting or kidnapping the adult, or a vehicle
8491 suspected of being used by the adult or in any abduction or
8592 kidnapping of the adult.
8693 (b) The department may modify the criteria described by
8794 Subsection (a) as necessary for the proper implementation of the
8895 alert system.
8996 Sec. 411.467. ACTIVATION OF ALERT. (a) When a local law
9097 enforcement agency notifies the department under Section 411.466,
9198 the department shall confirm the accuracy of the information and,
9299 if confirmed, immediately issue an alert under this subchapter in
93100 accordance with the department's rules and directives under Section
94101 411.463.
95102 (b) The department may issue the alert on its own
96103 initiative, without receiving the notification described by
97104 Subsection (a), if the issuance conforms to the department's rules
98105 and directives and if the criteria described by Section 411.466(a)
99106 are satisfied.
100107 (c) In issuing the alert, the department shall send the
101108 alert to designated media outlets in this state. Following receipt
102109 of the alert, participating radio stations and television stations
103110 and other participating media outlets may issue the alert at
104111 designated intervals to assist in locating the missing adult.
105112 (d) The department shall also send the alert to:
106113 (1) any appropriate law enforcement agency;
107114 (2) the Texas Department of Transportation;
108115 (3) the Texas Lottery Commission; and
109116 (4) the Independent Bankers Association of Texas.
110117 Sec. 411.468. CONTENT OF ALERT. The alert must include:
111118 (1) all appropriate information that may lead to the
112119 safe recovery of the missing adult, as determined by the
113120 department; and
114121 (2) a statement instructing any person with
115122 information related to the missing adult to contact a local or state
116123 law enforcement agency.
117124 Sec. 411.469. TERMINATION OF ALERT. (a) The director shall
118125 terminate any activation of the alert with respect to a particular
119126 missing adult not later than the earlier of the date on which:
120127 (1) the missing adult is located or the situation is
121128 otherwise resolved; or
122129 (2) the notification period ends, as determined by
123130 department rule.
124131 (b) A local law enforcement agency that locates a missing
125132 adult who is the subject of an alert under this subchapter shall
126133 notify the department as soon as possible that the missing adult has
127134 been located.
128135 Sec. 411.470. LIMITATION ON PARTICIPATION BY TEXAS
129136 DEPARTMENT OF TRANSPORTATION. Notwithstanding Section 411.465(b),
130137 the Texas Department of Transportation is not required to use any
131138 existing system of dynamic message signs in a statewide alert
132139 system created under this subchapter if the department receives
133140 notice from the United States Department of Transportation Federal
134141 Highway Administration that the use of the signs would result in the
135142 loss of federal highway funding or other punitive actions taken
136143 against this state due to noncompliance with federal laws,
137144 regulations, or policies.
138145 SECTION 2. (a) The Department of Public Safety of the State
139146 of Texas shall conduct a study on the effectiveness of the statewide
140147 alert system described by Subchapter Q, Chapter 411, Government
141148 Code, as added by this Act. The study must investigate whether the
142149 statewide alert system fulfills the purpose for which the alert
143150 system was created and whether the alert system should be modified
144151 or expanded.
145152 (b) Not later than December 31, 2020, the Department of
146153 Public Safety of the State of Texas shall submit to the governor,
147154 lieutenant governor, and speaker of the house of representatives a
148155 report containing the results of the study conducted under
149156 Subsection (a) of this section, including any recommendations for
150157 proposed legislation.
151158 (c) This section expires December 31, 2021.
152159 SECTION 3. This Act takes effect September 1, 2019.
