410 AN ACT
511 relating to the mandatory dismissal date of certain suits affecting
612 the parent-child relationship involving the Department of Family
713 and Protective Services.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Section 263.401, Family Code, is amended by
1016 adding Subsection (b-2) to read as follows:
1117 (b-2) When considering under Subsection (b) whether to find
1218 that extraordinary circumstances necessitate the child remaining
1319 in the temporary managing conservatorship of the department for a
1420 case in which the court orders a parent to complete a substance
1521 abuse treatment program, the court shall consider whether the
1622 parent made a good faith effort to successfully complete the
1723 program.
1824 SECTION 2. The changes in law made by this Act apply only to
1925 a suit affecting the parent-child relationship filed on or after
2026 the effective date of this Act. A suit affecting the parent-child
2127 relationship filed before that date is governed by the law in effect
2228 on the date the suit was filed, and that law is continued in effect
2329 for that purpose.
2430 SECTION 3. This Act takes effect September 1, 2019.
