66 AN ACT
77 relating to regulation of certain credit services organizations.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 393.221(1), Finance Code, is amended to
1010 read as follows:
1111 (1) "Credit access business" means a credit services
1212 organization that obtains for a consumer or assists a consumer in
1313 obtaining an extension of consumer credit, including an extension
1414 of consumer credit in the form of a deferred presentment
1515 transaction or a motor vehicle title loan.
1616 SECTION 2. Section 393.222(a), Finance Code, is amended to
1717 read as follows:
1818 (a) A credit access business shall post, in a conspicuous
1919 location in an area of the business accessible to consumers and on
2020 any Internet website, including a social media site, maintained by
2121 the credit access business:
2222 (1) a schedule of all fees to be charged for services
2323 performed by the credit access business in connection with the
2424 extension of consumer credit, including deferred presentment
2525 transactions and motor vehicle title loans[, as applicable];
2626 (2) a notice of the name and address of the Office of
2727 Consumer Credit Commissioner and the telephone number of the
2828 office's consumer helpline; and
2929 (3) for an extension of consumer credit in the form of
3030 a deferred presentment transaction or motor vehicle title loan, a
3131 notice that reads as follows:
3232 "An advance of money obtained through a payday loan or auto
3333 title loan is not intended to meet long-term financial needs. A
3434 payday loan or auto title loan should only be used to meet immediate
3535 short-term cash needs. Refinancing the loan rather than paying the
3636 debt in full when due will require the payment of additional
3737 charges."
3838 SECTION 3. Section 393.223(a), Finance Code, is amended to
3939 read as follows:
4040 (a) Before performing services described by Section
4141 393.221(1), a credit access business must provide to a consumer a
4242 disclosure adopted by rule of the Finance Commission of Texas that
4343 discloses the following in a form prescribed by the commission:
4444 (1) the interest, fees, and annual percentage rates,
4545 as applicable, to be charged on the extension of consumer credit
4646 that the credit access business proposes to obtain for the consumer
4747 or assist the consumer in obtaining [a deferred presentment
4848 transaction or on a motor vehicle title loan, as applicable,] in
4949 comparison to interest, fees, and annual percentage rates to be
5050 charged on other alternative forms of consumer debt;
5151 (2) the amount of accumulated fees a consumer would
5252 incur by renewing or refinancing the extension of consumer credit
5353 if it were to remain [a deferred presentment transaction or motor
5454 vehicle title loan that remains] outstanding for a period of two
5555 weeks, one month, two months, and three months; and
5656 (3) information regarding the typical pattern of
5757 repayment of extensions of consumer credit, including deferred
5858 presentment transactions and motor vehicle title loans.
5959 SECTION 4. Section 393.601(2), Finance Code, is amended to
6060 read as follows:
6161 (2) "Credit access business" means a credit services
6262 organization that obtains for a consumer or assists a consumer in
6363 obtaining an extension of consumer credit, including an extension
6464 of consumer credit in the form of a deferred presentment
6565 transaction or a motor vehicle title loan.
6666 SECTION 5. Section 393.602(a), Finance Code, is amended to
6767 read as follows:
6868 (a) This subchapter applies only to a credit services
6969 organization that obtains for a consumer or assists a consumer in
7070 obtaining an extension of consumer credit [in the form of:
7171 [(1) a deferred presentment transaction; or
7272 [(2) a motor vehicle title loan].
7373 SECTION 6. The changes in law made by this Act apply only to
7474 an extension of consumer credit made on or after the effective date
7575 of this Act. An extension of consumer credit made before the
7676 effective date of this Act is governed by the law in effect on the
7777 date the extension of consumer credit was made, and the former law
7878 is continued in effect for that purpose.
7979 SECTION 7. This Act takes effect September 1, 2019.
