9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 31.04, Penal Code, is amended by adding | |
11 | 11 | Subsection (h) to read as follows: | |
12 | 12 | (h) It is an exception to the application of Subsection | |
13 | 13 | (a)(3) that the written rental agreement described by that | |
14 | 14 | subsection is a rental-purchase agreement. For purposes of this | |
15 | 15 | subsection, "rental-purchase agreement" means an agreement under | |
16 | 16 | which an individual may use personal property for personal, family, | |
17 | 17 | or household purposes for an initial rental period and that: | |
18 | 18 | (1) is automatically renewable with each payment after | |
19 | 19 | the initial rental period; and | |
20 | 20 | (2) permits the individual to become the owner of the | |
21 | 21 | property. | |
22 | 22 | SECTION 2. The change in law made by this Act applies to an | |
23 | 23 | offense committed before, on, or after the effective date of this | |
24 | 24 | Act. However, a final conviction for an offense under Section | |
25 | 25 | 31.04, Penal Code, that exists on the effective date of this Act | |
26 | 26 | remains unaffected by this Act. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2019. |
