66 AN ACT
77 relating to an exception to prosecution for the criminal offense of
88 theft of service.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 31.04, Penal Code, is amended by adding
1111 Subsection (h) to read as follows:
1212 (h) It is an exception to the application of Subsection
1313 (a)(3) that the written rental agreement described by that
1414 subsection is a rental-purchase agreement. For purposes of this
1515 subsection, "rental-purchase agreement" means an agreement under
1616 which an individual may use personal property for personal, family,
1717 or household purposes for an initial rental period and that:
1818 (1) is automatically renewable with each payment after
1919 the initial rental period; and
2020 (2) permits the individual to become the owner of the
2121 property.
2222 SECTION 2. The change in law made by this Act applies to an
2323 offense committed before, on, or after the effective date of this
2424 Act. However, a final conviction for an offense under Section
2525 31.04, Penal Code, that exists on the effective date of this Act
2626 remains unaffected by this Act.
2727 SECTION 3. This Act takes effect September 1, 2019.
