86 AN ACT
97 relating to standards for nutrition, physical activity, and screen
108 time for certain child-care facilities and homes.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 42.042, Human Resources Code, is amended
1311 by adding Subsections (e-3) and (e-4) to read as follows:
14- (e-3) The minimum standards for a day-care center or a
15- registered family home adopted under Subsection (e) must be
16- consistent with:
17- (1) the most recent edition of the standards for
18- physical activity and screen time as published by the American
19- Academy of Pediatrics in Caring for Our Children: National Health
20- and Safety Performance Standards; Guidelines for Early Care and
21- Education Programs; and
12+ (e-3) The minimum standards adopted under Subsection (e)
13+ must be consistent with:
14+ (1) American Academy of Pediatrics standards for
15+ physical activity and screen time as published in Caring for Our
16+ Children: National Health and Safety Performance Standards;
17+ Guidelines for Early Care and Education Programs, 3rd Edition; and
2218 (2) the nutrition standards in the Child and Adult
2319 Care Food Program administered by the Department of Agriculture.
24- (e-4) A day-care center or registered family home is not
25- required to participate in or comply with the reporting
20+ (e-4) A licensed child-care facility or registered family
21+ home is not required to participate in or comply with the reporting
2622 requirements of the Child and Adult Care Food Program administered
2723 by the Department of Agriculture.
2824 SECTION 2. As soon as practicable after the effective date
2925 of this Act, the executive commissioner of the Health and Human
3026 Services Commission shall adopt the rules necessary to implement
3127 the changes in law made by this Act.
3228 SECTION 3. This Act takes effect September 1, 2019.
