55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to increasing the criminal penalty for certain boating
88 while intoxicated offenses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 49.06, Penal Code, is amended by
1111 amending Subsection (b) and adding Subsection (c) to read as
1212 follows:
1313 (b) Except as provided by Subsection (c) or Section 49.09,
1414 an offense under this section is a Class B misdemeanor, with a
1515 minimum term of confinement of 72 hours.
1616 (c) If it is shown on the trial of an offense under this
1717 section that an analysis of a specimen of the person's blood,
1818 breath, or urine showed an alcohol concentration level of 0.15 or
1919 more at the time the analysis was performed, the offense is a Class
2020 A misdemeanor.
2121 SECTION 2. The change in law made by this Act applies only
2222 to an offense committed on or after the effective date of this Act.
2323 An offense committed before the effective date of this Act is
2424 governed by the law in effect on the date the offense was committed,
2525 and the former law is continued in effect for that purpose. For
2626 purposes of this section, an offense was committed before the
2727 effective date of this Act if any element of the offense occurred
2828 before that date.
2929 SECTION 3. This Act takes effect September 1, 2019.
