66 AN ACT
77 relating to county regulation of roadside vendors and solicitors.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 285.001(a), Transportation Code, is
1010 amended to read as follows:
1111 (a) To promote the public safety, the commissioners court of
1212 a county with a population of more than 1.3 million and a county
1313 with a population of more than 550,000 that is adjacent to a county
1414 with a population of four million by order may regulate the
1515 following in the unincorporated area of the county if they occur on
1616 a public highway or road, in the right-of-way of a public highway or
1717 road, or in a parking lot:
1818 (1) the sale of items by a vendor of food or
1919 merchandise, including live animals;
2020 (2) the erection, maintenance, or placement of a
2121 structure by a vendor of food or merchandise, including live
2222 animals; and
2323 (3) the solicitation of money.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2019.
