66 AN ACT
77 relating to including the qualifications for voting early by mail
88 on the ground of disability on certain early voting by mail
99 materials.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 52.005, Election Code, is amended to
1212 read as follows:
1313 Sec. 52.005. BALLOT CONTENT DETERMINED ACCORDING TO
1414 PRECINCT. Except as provided by Section 52.009, the [The] ballot
1515 for an election precinct may contain only those offices and
1616 propositions stating measures on which the qualified voters of the
1717 precinct are entitled to vote.
1818 SECTION 2. Subchapter A, Chapter 52, Election Code, is
1919 amended by adding Section 52.009 to read as follows:
2020 Sec. 52.009. BALLOT FOR VOTING BY MAIL. A ballot to be
2121 voted by mail under Chapter 86 must include a statement describing
2222 the specific circumstances under which a voter may vote early by
2323 mail on the ground of disability as provided by Section 82.002.
2424 SECTION 3. Section 84.011(a), Election Code, is amended to
2525 read as follows:
2626 (a) The officially prescribed application form for an early
2727 voting ballot must include:
2828 (1) immediately preceding the signature space the
2929 statement: "I certify that the information given in this
3030 application is true, and I understand that giving false information
3131 in this application is a crime.";
3232 (2) a statement informing the applicant of the
3333 offenses prescribed by Sections 84.003 and 84.004;
3434 (3) spaces for entering an applicant's voter
3535 registration number and county election precinct of registration,
3636 with a statement informing the applicant that failure to furnish
3737 that information does not invalidate the application; and
3838 (4) on an application for a ballot to be voted by mail:
3939 (A) a space for an applicant applying on the
4040 ground of absence from the county of residence to indicate the date
4141 on or after which the applicant can receive mail at the address
4242 outside the county;
4343 (B) a space for indicating the fact that an
4444 applicant whose application is signed by a witness cannot make the
4545 applicant's mark and a space for indicating the relationship or
4646 lack of relationship of the witness to the applicant;
4747 (C) a space for entering an applicant's telephone
4848 number, with a statement informing the applicant that failure to
4949 furnish that information does not invalidate the application;
5050 (D) a space or box for an applicant applying on
5151 the ground of age or disability to indicate that the address to
5252 which the ballot is to be mailed is the address of a facility or
5353 relative described by Section 84.002(a)(3), if applicable;
5454 (E) a space or box for an applicant applying on
5555 the ground of confinement in jail to indicate that the address to
5656 which the ballot is to be mailed is the address of a relative
5757 described by Section 84.002(a)(4), if applicable;
5858 (F) a space for an applicant applying on the
5959 ground of age or disability to indicate if the application is an
6060 application under Section 86.0015;
6161 (G) spaces for entering the signature, printed
6262 name, and residence address of any person assisting the applicant;
6363 (H) a statement informing the applicant of the
6464 condition prescribed by Section 81.005; [and]
6565 (I) a statement informing the applicant of the
6666 requirement prescribed by Section 86.003(c); and
6767 (J) a statement describing the specific
6868 circumstances under which a voter may vote early by mail on the
6969 ground of disability as provided by Section 82.002.
7070 SECTION 4. Section 86.013(d), Election Code, is amended to
7171 read as follows:
7272 (d) The following textual material, as prescribed by the
7373 secretary of state, must be printed on the reverse side of the
7474 official carrier envelope or on a separate sheet accompanying the
7575 carrier envelope when it is provided:
7676 (1) the prohibition prescribed by Section 86.006(b);
7777 (2) the conditions for delivery by common or contract
7878 carrier prescribed by Sections 81.005 and 86.006;
7979 (3) the requirements for the legal execution and
8080 delivery of the carrier envelope, including the prohibition on
8181 compensation for depositing carrier envelopes containing ballots
8282 voted by other persons under Section 86.0052;
8383 (4) the prohibition prescribed by Section 86.006(e);
8484 [and]
8585 (5) the offenses prescribed by Sections 86.006(f) and
8686 86.010(f); and
8787 (6) a statement describing the specific circumstances
8888 under which a voter may vote early by mail on the ground of
8989 disability as provided by Section 82.002.
9090 SECTION 5. This Act takes effect September 1, 2019.
