8 | 8 | | on the ground of disability on certain early voting by mail |
---|

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 52.005, Election Code, is amended to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | Sec. 52.005. BALLOT CONTENT DETERMINED ACCORDING TO |
---|
14 | 14 | | PRECINCT. Except as provided by Section 52.009, the [The] ballot |
---|
15 | 15 | | for an election precinct may contain only those offices and |
---|
16 | 16 | | propositions stating measures on which the qualified voters of the |
---|
17 | 17 | | precinct are entitled to vote. |
---|
18 | 18 | | SECTION 2. Subchapter A, Chapter 52, Election Code, is |
---|
19 | 19 | | amended by adding Section 52.009 to read as follows: |
---|
20 | 20 | | Sec. 52.009. BALLOT FOR VOTING BY MAIL. A ballot to be |
---|
21 | 21 | | voted by mail under Chapter 86 must include a statement describing |
---|
22 | 22 | | the specific circumstances under which a voter may vote early by |
---|
23 | 23 | | mail on the ground of disability as provided by Section 82.002. |
---|
24 | 24 | | SECTION 3. Section 84.011(a), Election Code, is amended to |
---|
25 | 25 | | read as follows: |
---|
26 | 26 | | (a) The officially prescribed application form for an early |
---|
27 | 27 | | voting ballot must include: |
---|
28 | 28 | | (1) immediately preceding the signature space the |
---|
29 | 29 | | statement: "I certify that the information given in this |
---|
30 | 30 | | application is true, and I understand that giving false information |
---|
31 | 31 | | in this application is a crime."; |
---|
32 | 32 | | (2) a statement informing the applicant of the |
---|
33 | 33 | | offenses prescribed by Sections 84.003 and 84.004; |
---|
34 | 34 | | (3) spaces for entering an applicant's voter |
---|
35 | 35 | | registration number and county election precinct of registration, |
---|
36 | 36 | | with a statement informing the applicant that failure to furnish |
---|
37 | 37 | | that information does not invalidate the application; and |
---|
38 | 38 | | (4) on an application for a ballot to be voted by mail: |
---|
39 | 39 | | (A) a space for an applicant applying on the |
---|
40 | 40 | | ground of absence from the county of residence to indicate the date |
---|
41 | 41 | | on or after which the applicant can receive mail at the address |
---|
42 | 42 | | outside the county; |
---|
43 | 43 | | (B) a space for indicating the fact that an |
---|
44 | 44 | | applicant whose application is signed by a witness cannot make the |
---|
45 | 45 | | applicant's mark and a space for indicating the relationship or |
---|
46 | 46 | | lack of relationship of the witness to the applicant; |
---|
47 | 47 | | (C) a space for entering an applicant's telephone |
---|
48 | 48 | | number, with a statement informing the applicant that failure to |
---|
49 | 49 | | furnish that information does not invalidate the application; |
---|
50 | 50 | | (D) a space or box for an applicant applying on |
---|
51 | 51 | | the ground of age or disability to indicate that the address to |
---|
52 | 52 | | which the ballot is to be mailed is the address of a facility or |
---|
53 | 53 | | relative described by Section 84.002(a)(3), if applicable; |
---|
54 | 54 | | (E) a space or box for an applicant applying on |
---|
55 | 55 | | the ground of confinement in jail to indicate that the address to |
---|
56 | 56 | | which the ballot is to be mailed is the address of a relative |
---|
57 | 57 | | described by Section 84.002(a)(4), if applicable; |
---|
58 | 58 | | (F) a space for an applicant applying on the |
---|
59 | 59 | | ground of age or disability to indicate if the application is an |
---|
60 | 60 | | application under Section 86.0015; |
---|
61 | 61 | | (G) spaces for entering the signature, printed |
---|
62 | 62 | | name, and residence address of any person assisting the applicant; |
---|
63 | 63 | | (H) a statement informing the applicant of the |
---|
64 | 64 | | condition prescribed by Section 81.005; [and] |
---|
65 | 65 | | (I) a statement informing the applicant of the |
---|
66 | 66 | | requirement prescribed by Section 86.003(c); and |
---|
67 | 67 | | (J) a statement describing the specific |
---|
68 | 68 | | circumstances under which a voter may vote early by mail on the |
---|
69 | 69 | | ground of disability as provided by Section 82.002. |
---|
70 | 70 | | SECTION 4. Section 86.013(d), Election Code, is amended to |
---|
71 | 71 | | read as follows: |
---|
72 | 72 | | (d) The following textual material, as prescribed by the |
---|
73 | 73 | | secretary of state, must be printed on the reverse side of the |
---|
74 | 74 | | official carrier envelope or on a separate sheet accompanying the |
---|
75 | 75 | | carrier envelope when it is provided: |
---|
76 | 76 | | (1) the prohibition prescribed by Section 86.006(b); |
---|
77 | 77 | | (2) the conditions for delivery by common or contract |
---|
78 | 78 | | carrier prescribed by Sections 81.005 and 86.006; |
---|
79 | 79 | | (3) the requirements for the legal execution and |
---|
80 | 80 | | delivery of the carrier envelope, including the prohibition on |
---|
81 | 81 | | compensation for depositing carrier envelopes containing ballots |
---|
82 | 82 | | voted by other persons under Section 86.0052; |
---|
83 | 83 | | (4) the prohibition prescribed by Section 86.006(e); |
---|
84 | 84 | | [and] |
---|
85 | 85 | | (5) the offenses prescribed by Sections 86.006(f) and |
---|
86 | 86 | | 86.010(f); and |
---|
87 | 87 | | (6) a statement describing the specific circumstances |
---|
88 | 88 | | under which a voter may vote early by mail on the ground of |
---|
89 | 89 | | disability as provided by Section 82.002. |
---|
90 | 90 | | SECTION 5. This Act takes effect September 1, 2019. |
---|
