410 AN ACT
5- relating to the sale and taking of sand, gravel, marl, shell, and
6- mudshell, including the use of f
7- unds collected from the sale of
8- those materials and the taking of those materials from the San
9- Jacinto River and its tributaries.
11+ relating to use of funds collected by the Parks and Wildlife
12+ Commission from the sale of certain materials.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Section 86.017, Parks and Wildlife Code, is
1215 amended to read as follows:
1316 Sec. 86.017. USE OF FUNDS. (a) Except as provided by
1417 Subsection (b), funds [Funds] collected by the commission from the
1518 sale of marl, sand, gravel, shell, and mudshell may be used for:
1619 (1) the enforcement of the provisions of this chapter;
1720 (2) [,] the payment of refunds;
1821 (3) [, and] the construction and maintenance of fish
1922 hatcheries; and
2023 (4) the enhancement, preservation, and restoration of
2124 fish habitats in rivers and streams.
2225 (b) No less than three-fourths of the proceeds from the sale
2326 of marl, sand, gravel, shell, and mudshell, after the payment of
2427 refunds, shall be used for:
2528 (1) the construction and maintenance of fish
2629 hatcheries; and
2730 (2) the enhancement, preservation, and restoration of
2831 fish habitats in rivers and streams.
29- SECTION 2. Chapter 86, Parks and Wildlife Code, is amended
30- by adding Section 86.0192 to read as follows:
31- Sec. 86.0192. EXEMPTION FOR CERTAIN POLITICAL
32- SUBDIVISIONS. (a) This section applies only to the following
33- political subdivisions:
34- (1) San Jacinto River Authority; and
35- (2) Harris County Flood Control District.
36- (b) A political subdivision may take sand, gravel, marl,
37- shell, and mudshell from the San Jacinto River and its tributaries
38- to restore, maintain, or expand the capacity of the river and its
39- tributaries to convey storm flows.
40- (c) A political subdivision acting under this section is not
41- required to:
42- (1) obtain a permit or pay a fee to take sand, gravel,
43- marl, shell, or mudshell under Subsection (b); or
44- (2) purchase sand, gravel, marl, shell, or mudshell
45- taken under Subsection (b).
46- (d) A political subdivision acting under this section may
47- deposit sand, gravel, marl, shell, or mudshell taken under
48- Subsection (b) on private land.
49- SECTION 3. This Act takes effect September 1, 2019.
