5		-	relating to the sale and taking of sand, gravel, marl, shell, and
6		-	mudshell, including the use of f

8		-	those materials and the taking of those materials from the San
9		-	Jacinto River and its tributaries.

10	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	14		SECTION 1. Section 86.017, Parks and Wildlife Code, is
12	15		amended to read as follows:
13	16		Sec. 86.017. USE OF FUNDS. (a) Except as provided by
14	17		Subsection (b), funds [Funds] collected by the commission from the
15	18		sale of marl, sand, gravel, shell, and mudshell may be used for:
16	19		(1) the enforcement of the provisions of this chapter;
17	20		(2) [,] the payment of refunds;
18	21		(3) [, and] the construction and maintenance of fish
19	22		hatcheries; and
20	23		(4) the enhancement, preservation, and restoration of
21	24		fish habitats in rivers and streams.
22	25		(b) No less than three-fourths of the proceeds from the sale
23	26		of marl, sand, gravel, shell, and mudshell, after the payment of
24	27		refunds, shall be used for:
25	28		(1) the construction and maintenance of fish
26	29		hatcheries; and
27	30		(2) the enhancement, preservation, and restoration of
28	31		fish habitats in rivers and streams.
29		-	SECTION 2. Chapter 86, Parks and Wildlife Code, is amended
30		-	by adding Section 86.0192 to read as follows:
31		-	Sec. 86.0192. EXEMPTION FOR CERTAIN POLITICAL
32		-	SUBDIVISIONS. (a) This section applies only to the following
33		-	political subdivisions:
34		-	(1) San Jacinto River Authority; and
35		-	(2) Harris County Flood Control District.
36		-	(b) A political subdivision may take sand, gravel, marl,
37		-	shell, and mudshell from the San Jacinto River and its tributaries
38		-	to restore, maintain, or expand the capacity of the river and its
39		-	tributaries to convey storm flows.
40		-	(c) A political subdivision acting under this section is not
41		-	required to:
42		-	(1) obtain a permit or pay a fee to take sand, gravel,
43		-	marl, shell, or mudshell under Subsection (b); or
44		-	(2) purchase sand, gravel, marl, shell, or mudshell
45		-	taken under Subsection (b).
46		-	(d) A political subdivision acting under this section may
47		-	deposit sand, gravel, marl, shell, or mudshell taken under
48		-	Subsection (b) on private land.
49		-	SECTION 3. This Act takes effect September 1, 2019.
