76 AN ACT
87 relating to prohibited practices relating to health benefit plan
98 coverage for emergency care.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Section 533.005, Government Code, is amended by
1211 adding Subsection (e) to read as follows:
1312 (e) In addition to the requirements under Subsection (a), a
1413 contract described by that subsection must require the managed care
1514 organization to comply with Section 541.062, Insurance Code.
1615 SECTION 2. Subchapter B, Chapter 541, Insurance Code, is
1716 amended by adding Section 541.062 to read as follows:
1817 Sec. 541.062. EMERGENCY CARE. (a) In this section,
1918 "emergency care" and "utilization review" have the meanings
2019 assigned by Section 4201.002.
2120 (b) It is an unfair method of competition or an unfair or
2221 deceptive act or practice in the business of insurance to make
2322 health benefit plan coverage for an emergency care claim dependent
2423 on a utilization review determination that the patient's medical
2524 condition required emergency care.
2625 SECTION 3. Section 541.062, Insurance Code, as added by
2726 this Act, applies only to a health benefit plan delivered, issued
2827 for delivery, or renewed on or after January 1, 2020. A health
2928 benefit plan delivered, issued for delivery, or renewed before
3029 January 1, 2020, is governed by the law as it existed immediately
3130 before the effective date of this Act, and that law is continued in
3231 effect for that purpose.
3332 SECTION 4. If before implementing any provision of this Act
3433 a state agency determines that a waiver or authorization from a
3534 federal agency is necessary for implementation of that provision,
3635 the agency affected by the provision shall request the waiver or
3736 authorization and may delay implementing that provision until the
3837 waiver or authorization is granted.
3938 SECTION 5. This Act takes effect September 1, 2019.
