66 AN ACT
77 relating to the notification of a peace officer through an
88 indication associated with vehicle registration or a driver's
99 license that a person has a health condition that may impede
1010 communication.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 502, Transportation Code,
1313 is amended by adding Section 502.061 to read as follows:
1414 Sec. 502.061. REGISTRATION BY OWNER WITH CONDITION THAT
1515 IMPEDES COMMUNICATION. (a) An application for registration must
1616 provide space for the applicant to voluntarily list any health
1717 condition that may impede communication with a peace officer as
1818 evidenced by:
1919 (1) for a physical health condition, a written
2020 statement from a licensed physician; or
2121 (2) for a mental health condition, a written statement
2222 from a licensed physician, a licensed psychologist, or a
2323 non-physician mental health professional, as defined by Section
2424 571.003, Health and Safety Code.
2525 (b) The department shall provide to the Department of Public
2626 Safety the vehicle registration information of a person who
2727 voluntarily lists a health condition on an application under
2828 Subsection (a).
2929 (c) The Department of Public Safety shall establish a system
3030 to include information received under Subsection (b) in the Texas
3131 Law Enforcement Telecommunications System for the purpose of
3232 alerting a peace officer who makes a traffic stop that the operator
3333 of the stopped vehicle may have a health condition that may impede
3434 communication.
3535 (d) The department may not issue a license plate with a
3636 visible marking that indicates to the general public that a person
3737 voluntarily listed a health condition on an application under
3838 Subsection (a).
3939 SECTION 2. Sections 521.142(e-1) and (h), Transportation
4040 Code, are amended to read as follows:
4141 (e-1) Subject to Subsection (h)(2), other [Other] than a
4242 general inquiry as to whether the applicant has a mental condition
4343 that may affect the applicant's ability to safely operate a motor
4444 vehicle, an application may not include an inquiry regarding the
4545 mental health of the applicant, including an inquiry as to whether
4646 the applicant has been diagnosed with, treated for, or hospitalized
4747 for a psychiatric disorder.
4848 (h) The application must provide space for the applicant to
4949 voluntarily list any health condition that may impede communication
5050 with a peace officer as evidenced by:
5151 (1) for a physical health condition, a written
5252 statement from a licensed physician; or
5353 (2) for a mental health condition, a written statement
5454 from a licensed physician, a licensed psychologist, or a
5555 non-physician mental health professional, as defined by Section
5656 571.003, Health and Safety Code.
5757 SECTION 3. This Act takes effect September 1, 2019.
