411 AN ACT
512 relating to prevention of communicable diseases in certain
613 long-term care facilities.
714 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
815 SECTION 1. Section 81.003, Health and Safety Code, is
916 amended by amending Subdivision (4-a) and adding Subdivision (4-b)
1017 to read as follows:
1118 (4-a) "Long-term care facility" means a facility
1219 licensed or regulated under Chapter 242, 247, or 252.
1320 (4-b) "Peace officer" has the meaning assigned by
1421 Article 2.12, Code of Criminal Procedure. The term includes a
1522 sheriff or constable.
1623 SECTION 2. Subchapter A, Chapter 81, Health and Safety
1724 Code, is amended by adding Sections 81.014 and 81.015 to read as
1825 follows:
1926 Sec. 81.014. LONG-TERM CARE FACILITY INFECTION PREVENTION
2027 AND CONTROL PROGRAM. Each long-term care facility's infection
2128 prevention and control program must include:
2229 (1) monitoring of key infectious agents,
2330 including multidrug-resistant organisms; and
2431 (2) procedures for making rapid influenza diagnostic
2532 tests available to facility residents.
2633 Sec. 81.015. ANTIMICROBIAL STEWARDSHIP REGIONAL ADVISORY
2734 COMMITTEES. (a) The department shall establish a regional
2835 advisory committee in each public health region designated under
2936 Section 121.007 to address antimicrobial stewardship in long-term
3037 care facilities and to improve antimicrobial stewardship through
3138 collaborative action.
3239 (b) A regional advisory committee established under this
3340 section must include:
3441 (1) physicians;
3542 (2) directors of nursing or equivalent consultants
3643 with long-term care facilities;
3744 (3) public health officials knowledgeable about
3845 antimicrobial stewardship; and
3946 (4) other interested parties.
4047 SECTION 3. This Act takes effect September 1, 2019.
