410 AN ACT
511 relating to the availability of certain voter information.
612 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
713 SECTION 1. Section 85.072, Election Code, is amended by
814 adding Subsections (f) and (g) to read as follows:
915 (f) The early voting clerk shall provide, in a downloadable
1016 database format, a current copy of the register for posting on the
1117 Internet website of the authority ordering the election, if the
1218 authority maintains a website, each day early voting is conducted.
1319 At a minimum, the voter registration number for each voter listed in
1420 the register must be posted.
1521 (g) The early voting clerk shall compile the registers and
1622 electronically submit to the secretary of state a record of each
1723 voter participating in a primary, a runoff primary, a general
1824 election, or any special election ordered by the governor not later
1925 than the day the voter votes in person or the early voting clerk
2026 receives a ballot voted by mail.
2127 SECTION 2. Section 87.121, Election Code, is amended by
2228 amending Subsections (g) and (h) and adding Subsections (i) and (j)
2329 to read as follows:
2430 (g) Information on the roster for a person who votes an
2531 early voting ballot by personal appearance shall be made available
2632 for public inspection as provided by Subsection (i) not later than
2733 11 a.m. [the beginning of regular business hours] on the day after
2834 the date the information is entered on the roster under Subsection
2935 (c).
3036 (h) Information on the roster for a person who votes an
3137 early voting ballot by mail shall be made available for public
3238 inspection as provided by Subsection (i) not later than 11 a.m. on
3339 the day following the day the early voting clerk receives a ballot
3440 voted by mail.
3541 (i) The information under Subsections (g) and (h) must be
3642 made available:
3743 (1) for an election in which the county clerk is the
3844 early voting clerk:
3945 (A) on the publicly accessible Internet website
4046 of the county; or
4147 (B) if the county does not maintain a website, on
4248 the bulletin board used for posting notice of meetings of the
4349 commissioners court; or
4450 (2) for an election not described by Subdivision (1):
4551 (A) on the publicly accessible Internet website
4652 of the authority ordering the election; or
4753 (B) if the authority ordering the election does
4854 not maintain a website, on the bulletin board used for posting
4955 notice of meetings of the governing body of the authority.
5056 (j) The secretary of state shall make any early voting
5157 roster created under this section available to the public on the
5258 secretary's Internet website.
5359 SECTION 3. This Act takes effect September 1, 2019.
