4	10		AN ACT
5	11		relating to the availability of certain voter information.
6	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	13		SECTION 1. Section 85.072, Election Code, is amended by
8	14		adding Subsections (f) and (g) to read as follows:
9	15		(f) The early voting clerk shall provide, in a downloadable
10	16		database format, a current copy of the register for posting on the
11	17		Internet website of the authority ordering the election, if the
12	18		authority maintains a website, each day early voting is conducted.
13	19		At a minimum, the voter registration number for each voter listed in
14	20		the register must be posted.
15	21		(g) The early voting clerk shall compile the registers and
16	22		electronically submit to the secretary of state a record of each
17	23		voter participating in a primary, a runoff primary, a general
18	24		election, or any special election ordered by the governor not later
19	25		than the day the voter votes in person or the early voting clerk
20	26		receives a ballot voted by mail.
21	27		SECTION 2. Section 87.121, Election Code, is amended by
22	28		amending Subsections (g) and (h) and adding Subsections (i) and (j)
23	29		to read as follows:
24	30		(g) Information on the roster for a person who votes an
25	31		early voting ballot by personal appearance shall be made available
26	32		for public inspection as provided by Subsection (i) not later than
27	33		11 a.m. [the beginning of regular business hours] on the day after
28	34		the date the information is entered on the roster under Subsection
29	35		(c).
30	36		(h) Information on the roster for a person who votes an
31	37		early voting ballot by mail shall be made available for public
32	38		inspection as provided by Subsection (i) not later than 11 a.m. on
33	39		the day following the day the early voting clerk receives a ballot
34	40		voted by mail.
35	41		(i) The information under Subsections (g) and (h) must be
36	42		made available:
37	43		(1) for an election in which the county clerk is the
38	44		early voting clerk:
39	45		(A) on the publicly accessible Internet website
40	46		of the county; or
41	47		(B) if the county does not maintain a website, on
42	48		the bulletin board used for posting notice of meetings of the
43	49		commissioners court; or
44	50		(2) for an election not described by Subdivision (1):
45	51		(A) on the publicly accessible Internet website
46	52		of the authority ordering the election; or
47	53		(B) if the authority ordering the election does
48	54		not maintain a website, on the bulletin board used for posting
49	55		notice of meetings of the governing body of the authority.
50	56		(j) The secretary of state shall make any early voting
51	57		roster created under this section available to the public on the
52	58		secretary's Internet website.
53	59		SECTION 3. This Act takes effect September 1, 2019.
