86 AN ACT
97 relating to restrictions on hours of employment for children;
108 creating criminal offenses.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. The heading to Section 51.013, Labor Code, is
13- amended to read as follows:
14- Sec. 51.013. HOURS OF EMPLOYMENT; HARDSHIP EXEMPTION;
15- FAMILY EMPLOYMENT EXEMPTION.
16- SECTION 2. Section 51.013, Labor Code, is amended by
17- amending Subsections (a), (b), and (c) and adding Subsections
18- (a-1), (b-1), and (e) to read as follows:
10+ SECTION 1. Section 51.013, Labor Code, is amended by
11+ amending Subsections (a), (b), and (c) and adding Subsections (a-1)
12+ and (b-1) to read as follows:
1913 (a) A person commits an offense if the person permits a
2014 child who is 14 or 15 years of age and who is employed by the person
2115 to work more than:
2216 (1) eight hours in one day; [or]
2317 (2) 48 hours in one week; or
2418 (3) five days in one week.
2519 (a-1) A person commits an offense if the person permits a
2620 child who is 16 years of age and who is employed by the person to
2721 work more than:
2822 (1) 10 hours in one day;
2923 (2) 54 hours in one week; or
3024 (3) six days in one week.
3125 (b) A person commits an offense if the person permits a
3226 child who is 14 or 15 years of age, is employed by the person, and is
3327 enrolled in a term of a public or private school to work:
3428 (1) between the hours of 7 [10] p.m. and 6 [5] a.m. on a
3529 day that is followed by a school day; or
3630 (2) between the hours of 11 p.m. [midnight] and 6 [5]
3731 a.m. on a day that is not followed by a school day.
3832 (b-1) A person commits an offense if the person permits a
3933 child who is 16 years of age, is employed by the person, and is
4034 enrolled in a term of a public or private school to work between the
4135 hours of 11 p.m. and 6 a.m. on a day that is followed by a school
4236 day.
4337 (c) A person commits an offense if the person permits a
4438 child who is 14 or 15 years of age, is employed by the person, and is
4539 not enrolled in summer school to work between the hours of 11 p.m.
4640 [midnight] and 6 [5] a.m. on any day during the time that school is
4741 recessed for the summer.
48- (e) This section does not apply if:
49- (1) the child is a member of the person's family or
50- household, as those terms are defined by Chapter 71, Family Code;
51- and
52- (2) the person employs not more than 50 employees,
53- including the child.
54- SECTION 3. The change in law made by this Act applies only

5543 to an offense committed on or after the effective date of this Act.
5644 An offense committed before the effective date of this Act is
5745 governed by the law in effect on the date the offense was committed,
5846 and the former law is continued in effect for that purpose. For
5947 purposes of this section, an offense was committed before the
6048 effective date of this Act if any element of the offense occurred
6149 before that date.
62- SECTION 4. This Act takes effect September 1, 2019.
50+ SECTION 3. This Act takes effect September 1, 2019.
