55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the election of board members and filling of vacant
88 board positions for emergency services districts in certain
99 counties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 775.034(h), Health and Safety Code, is
1212 amended to read as follows:
1313 (h) This section does not apply to a district located wholly
1414 in a county:
1515 (1) with a population of more than three million;
1616 (2) with a population of more than 200,000 that
1717 borders Lake Palestine; [or]
1818 (3) with a population of less than 200,000 that
1919 borders another state and the Gulf Intracoastal Waterway; or
2020 (4) with a population of more than 1.5 million that
2121 does not border another county with a population of more than 1.5
2222 million.
2323 SECTION 2. Section 775.0345(a), Health and Safety Code, is
2424 amended to read as follows:
2525 (a) This section applies only to a district located wholly
2626 in a county:
2727 (1) with a population of more than three million;
2828 (2) with a population of more than 200,000 that
2929 borders Lake Palestine; [or]
3030 (3) with a population of less than 200,000 that
3131 borders another state and the Gulf Intracoastal Waterway; or
3232 (4) with a population of more than 1.5 million that
3333 does not border another county with a population of more than 1.5
3434 million.
3535 SECTION 3. Section 775.0355(b), Health and Safety Code, is
3636 amended to read as follows:
3737 (b) This section applies only to a district located wholly
3838 in a county:
3939 (1) with a population of more than three million;
4040 (2) with a population of more than 200,000 that
4141 borders Lake Palestine; [or]
4242 (3) with a population of less than 200,000 that
4343 borders another state and the Gulf Intracoastal Waterway; or
4444 (4) with a population of more than 1.5 million that
4545 does not border another county with a population of more than 1.5
4646 million.
4747 SECTION 4. Section 775.0445(b), Health and Safety Code, is
4848 amended to read as follows:
4949 (b) This section applies only to a district located wholly
5050 in a county:
5151 (1) with a population of more than three million;
5252 (2) with a population of more than 200,000 that
5353 borders Lake Palestine; [or]
5454 (3) with a population of less than 200,000 that
5555 borders another state and the Gulf Intracoastal Waterway; or
5656 (4) with a population of more than 1.5 million that
5757 does not border another county with a population of more than 1.5
5858 million.
5959 SECTION 5. Section 775.082(e-1), Health and Safety Code, is
6060 amended to read as follows:
6161 (e-1) When a district located wholly in one county fails to
6262 complete and file the audit report by September 1 of each year and a
6363 county auditor is not ordered to prepare the report, the president
6464 and treasurer of the board are removed from the board and the
6565 commissioners court shall fill the vacancies for the remainder of
6666 the unexpired term [as provided by Section 775.034].
6767 SECTION 6. (a) This Act does not prohibit a person who is a
6868 commissioner on the effective date of this Act and who was appointed
6969 under Section 775.034, Health and Safety Code, from running for
7070 election to the board if the person has the qualifications required
7171 for a member under Section 775.0345, Health and Safety Code, as
7272 amended by this Act.
7373 (b) The terms of the members of a board of emergency
7474 services commissioners serving on the effective date of this Act
7575 who were appointed under Section 775.034, Health and Safety Code,
7676 before the effective date of this Act expire on the date a majority
7777 of the members of the initial board of emergency services
7878 commissioners elected under Subsection (c) of this section qualify
7979 to serve.
8080 (c) The county judge of a county with an emergency services
8181 district to which Section 775.0345(a)(4), Health and Safety Code,
8282 as added by this Act, applies on the effective date of this Act and
8383 to which Section 775.034, Health and Safety Code, previously
8484 applied, shall establish an election to elect the initial emergency
8585 services commissioners of that district in the manner required by
8686 Section 775.0345, Health and Safety Code, for election of the
8787 initial commissioners as if the district had been created on the
8888 effective date of this Act.
8989 SECTION 7. This Act takes effect September 1, 2020.
