56 AN ACT
67 relating to a report by the Texas Division of Emergency Management
78 regarding building trade services following disasters.
89 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
910 SECTION 1. Subchapter C, Chapter 418, Government Code, is
1011 amended by adding Section 418.054 to read as follows:
1112 Sec. 418.054. REPORT ON BUILDING TRADE SERVICES FOLLOWING
1213 DISASTERS. (a) Not later than November 1, 2020, the division shall
1314 submit a report to members of the legislature on improving the
1415 oversight, accountability, and availability of building trade
1516 services following disasters. The report must include:
16- (1) the number and economic impact of tradespeople in
17- communities affected by a disaster;
18- (2) strategies for using a workforce that has been
19- trained in a United States Department of Labor Industry-Recognized
20- Apprenticeship Program or Registered Apprenticeship Program to
21- increase the availability of tradespeople, including plumbers and
22- electricians, following a disaster;
23- (3) approaches to increase prosecutions of alleged
24- fraud relating to building trade services offered following a
25- disaster, including wage theft and worker misclassification; and
26- (4) methods to encourage performance bond
17+ (1) strategies to increase the availability of
18+ tradespeople, including plumbers and electricians, following a
19+ disaster;
20+ (2) approaches to increase prosecutions of alleged
21+ fraud related to building trade services offered following a
22+ disaster; and
23+ (3) methods to encourage performance bond
2724 requirements in contracts for building trade services to be
2825 performed following a disaster.
2926 (b) The division shall consult with appropriate state
3027 entities, including the Texas A&M AgriLife Extension Service and
3128 Texas Department of Licensing and Regulation, local governments,
32- trade associations, United States Department of Labor Registered
33- Apprenticeship Programs, and law enforcement groups in preparing
34- the report described by Subsection (a).
35- (c) The report described by Subsection (a) must include the
36- methodology of the contents of the report, including the type and
37- nature of information provided by the entities described by
38- Subsection (b).
39- (d) This section expires January 1, 2021.
