16 | 13 | | Sec. 531.0997. AUTOMATIC ENROLLMENT OF CERTAIN WOMEN IN |
---|
17 | 14 | | HEALTHY TEXAS WOMEN PROGRAM. (a) In this section, "Healthy Texas |
---|
18 | 15 | | Women program" means a program operated by the commission that is |
---|
19 | 16 | | substantially similar to the demonstration project operated under |
---|
20 | 17 | | former Section 32.0248, Human Resources Code, and that is intended |
---|
21 | 18 | | to expand access to preventive health and family planning services |
---|
22 | 19 | | for women in this state. |
---|
23 | 20 | | (b) Subject to the eligibility requirements of the Healthy |
---|
24 | 21 | | Texas Women program, the commission shall identify and |
---|
25 | 22 | | automatically enroll in the program a woman who is a Medicaid |
---|
26 | 23 | | recipient or enrollee in the child health plan program but who will |
---|
27 | 24 | | lose eligibility for benefits under the applicable program because |
---|
28 | 25 | | of the woman's age. The commission shall implement the automatic |
---|
29 | 26 | | enrollment in a manner that: |
---|
30 | 27 | | (1) ensures a seamless transition in the provision of |
---|
31 | 28 | | services between Medicaid or the child health plan program, as |
---|
32 | 29 | | applicable, and the Healthy Texas Women program; and |
---|
33 | 30 | | (2) allows a woman to begin receiving services through |
---|
34 | 31 | | the Healthy Texas Women program on the first day the woman is no |
---|
35 | 32 | | longer eligible for Medicaid or the child health plan program, as |
---|
36 | 33 | | applicable. |
---|
37 | 34 | | (c) The commission shall, at the time a woman is |
---|
38 | 35 | | automatically enrolled under Subsection (b) in the Healthy Texas |
---|
39 | 36 | | Women program: |
---|
40 | 37 | | (1) provide to the woman written notice that: |
---|
41 | 38 | | (A) she has been automatically enrolled in the |
---|
42 | 39 | | program but may disenroll; and |
---|
43 | 40 | | (B) instructs the woman on how to disenroll from |
---|
44 | 41 | | the program; and |
---|
45 | 42 | | (2) provide to the woman information about the |
---|
46 | 43 | | program, including the services provided under the program. |
---|
47 | 44 | | (d) The executive commissioner shall adopt rules necessary |
---|
48 | 45 | | to implement this section. |
---|
49 | 46 | | Sec. 531.09971. AUTOMATIC ENROLLMENT OF CERTAIN WOMEN IN |

74 | 80 | | SECTION 2. The changes in law made by this Act apply to a |
---|
75 | 81 | | woman who is a recipient of medical assistance under Chapter 32, |
---|
76 | 82 | | Human Resources Code, benefits through the child health plan |
---|
77 | 83 | | program under Chapter 62, Health and Safety Code, or services |
---|
78 | 84 | | through the Healthy Texas Women program, on or after the effective |
---|
79 | 85 | | date of this Act, regardless of the date on which eligibility for |
---|
80 | 86 | | medical assistance, the child health plan program, or the Healthy |
---|
81 | 87 | | Texas Women program was determined. |
---|
82 | 88 | | SECTION 3. If before implementing any provision of this Act |
---|
83 | 89 | | a state agency determines that a waiver or authorization, including |
---|
84 | 90 | | a state plan amendment, from a federal agency is necessary for |
---|
85 | 91 | | implementation of that provision, the agency affected by the |
---|
86 | 92 | | provision shall request the waiver or authorization and may delay |
---|
87 | 93 | | implementing that provision until the waiver or authorization is |
---|
88 | 94 | | granted. |
---|
89 | 95 | | SECTION 4. This Act takes effect September 1, 2019. |
