107 relating to the automatic enrollment of certain women in Medicaid
11- and the Healthy Texas Women program.

129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1411 amended by adding Sections 531.0997 and 531.09971 to read as
1512 follows:
1613 Sec. 531.0997. AUTOMATIC ENROLLMENT OF CERTAIN WOMEN IN
1714 HEALTHY TEXAS WOMEN PROGRAM. (a) In this section, "Healthy Texas
1815 Women program" means a program operated by the commission that is
1916 substantially similar to the demonstration project operated under
2017 former Section 32.0248, Human Resources Code, and that is intended
2118 to expand access to preventive health and family planning services
2219 for women in this state.
2320 (b) Subject to the eligibility requirements of the Healthy
2421 Texas Women program, the commission shall identify and
2522 automatically enroll in the program a woman who is a Medicaid
2623 recipient or enrollee in the child health plan program but who will
2724 lose eligibility for benefits under the applicable program because
2825 of the woman's age. The commission shall implement the automatic
2926 enrollment in a manner that:
3027 (1) ensures a seamless transition in the provision of
3128 services between Medicaid or the child health plan program, as
3229 applicable, and the Healthy Texas Women program; and
3330 (2) allows a woman to begin receiving services through
3431 the Healthy Texas Women program on the first day the woman is no
3532 longer eligible for Medicaid or the child health plan program, as
3633 applicable.
3734 (c) The commission shall, at the time a woman is
3835 automatically enrolled under Subsection (b) in the Healthy Texas
3936 Women program:
4037 (1) provide to the woman written notice that:
4138 (A) she has been automatically enrolled in the
4239 program but may disenroll; and
4340 (B) instructs the woman on how to disenroll from
4441 the program; and
4542 (2) provide to the woman information about the
4643 program, including the services provided under the program.
4744 (d) The executive commissioner shall adopt rules necessary
4845 to implement this section.
4946 Sec. 531.09971. AUTOMATIC ENROLLMENT OF CERTAIN WOMEN IN
50- MEDICAID. (a) In this section, "Healthy Texas Women program" has
51- the meaning assigned by Section 531.0997.
47+ MEDICAID OR CHIP PERINATAL PROGRAM. (a) In this section:
48+ (1) "CHIP perinatal program" means the perinatal
49+ program operated under the child health plan program established
50+ under Chapter 62, Health and Safety Code.
51+ (2) "Healthy Texas Women program" has the meaning
52+ assigned by Section 531.0997.
5253 (b) The commission shall identify and automatically enroll
53- in Medicaid a woman who:
54+ in Medicaid or the CHIP perinatal program, as applicable, a woman
55+ who:
5456 (1) becomes pregnant while receiving services through
5557 the Healthy Texas Women program; and
56- (2) is eligible for Medicaid.
58+ (2) is eligible for Medicaid or the CHIP perinatal
59+ program.
5760 (c) The commission shall implement the automatic enrollment
5861 in a manner that:
5962 (1) ensures a seamless transition in the provision of
60- services between the Healthy Texas Women program and Medicaid; and
63+ services between the Healthy Texas Women program and Medicaid or
64+ the CHIP perinatal program, as applicable; and
6165 (2) allows a woman to begin receiving services through
62- Medicaid on the first day the woman is enrolled in the program.
66+ Medicaid or the CHIP perinatal program, as applicable, on the first
67+ day the woman is enrolled in the program.
6368 (d) The commission shall, at the time a woman is
64- automatically enrolled under Subsection (b) in Medicaid:
69+ automatically enrolled under Subsection (b) in Medicaid or the CHIP
70+ perinatal program, as applicable:
6571 (1) provide to the woman written notice that:
6672 (A) she has been automatically enrolled in the
67- program but may disenroll; and
73+ applicable program but may disenroll; and
6874 (B) instructs the woman on how to disenroll from
6975 the program; and
7076 (2) provide to the woman information about the
7177 program, including the services provided under the program.
7278 (e) The executive commissioner shall adopt rules necessary
7379 to implement this section.
7480 SECTION 2. The changes in law made by this Act apply to a
7581 woman who is a recipient of medical assistance under Chapter 32,
7682 Human Resources Code, benefits through the child health plan
7783 program under Chapter 62, Health and Safety Code, or services
7884 through the Healthy Texas Women program, on or after the effective
7985 date of this Act, regardless of the date on which eligibility for
8086 medical assistance, the child health plan program, or the Healthy
8187 Texas Women program was determined.
8288 SECTION 3. If before implementing any provision of this Act
8389 a state agency determines that a waiver or authorization, including
8490 a state plan amendment, from a federal agency is necessary for
8591 implementation of that provision, the agency affected by the
8692 provision shall request the waiver or authorization and may delay
8793 implementing that provision until the waiver or authorization is
8894 granted.
8995 SECTION 4. This Act takes effect September 1, 2019.
