| 7 | 7 | | relating to the availability on the Internet of personal financial |

| 8 | 8 | | statements filed by public officials. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Sections 572.032(a) and (c), Government Code, |
|---|
| 11 | 11 | | are amended to read as follows: |
|---|
| 12 | 12 | | (a) Financial statements filed under this subchapter are |
|---|
| 13 | 13 | | public records. The commission shall maintain the statements in |
|---|
| 14 | 14 | | separate alphabetical files and in a manner that is accessible to |
|---|
| 15 | 15 | | the public during regular office hours and make the statements |
|---|
| 16 | 16 | | available to the public on the commission's Internet website. |
|---|
| 17 | 17 | | (c) After the second anniversary of the date the individual |
|---|
| 18 | 18 | | ceases to be a state officer, the commission may and on notification |
|---|
| 19 | 19 | | from the former state officer shall: |
|---|
| 20 | 20 | | (1) destroy each financial statement filed by the |
|---|
| 21 | 21 | | state officer; and |
|---|
| 22 | 22 | | (2) remove each financial statement filed by the state |
|---|
| 23 | 23 | | officer from the commission's Internet website. |
|---|
| 24 | 24 | | SECTION 2. Section 572.032(a-1), Government Code, as |
|---|
| 25 | 25 | | amended by Chapters 34 (S.B. 1576) and 983 (H.B. 776), Acts of the |
|---|
| 26 | 26 | | 85th Legislature, Regular Session, 2017, is reenacted and amended |
|---|
| 27 | 27 | | to read as follows: |
|---|
| 28 | 28 | | (a-1) The commission shall remove the home address, the |
|---|
| 29 | 29 | | telephone number, and the names of the dependent children of an |
|---|
| 30 | 30 | | individual from a financial statement filed by the individual under |
|---|
| 31 | 31 | | this subchapter before: |
|---|
| 32 | 32 | | (1) permitting a member of the public to view the |
|---|
| 33 | 33 | | statement; |
|---|
| 34 | 34 | | (2) providing a copy of the statement to a member of |
|---|
| 35 | 35 | | the public; or |
|---|
| 36 | 36 | | (3) making the statement available to the public on |
|---|
| 37 | 37 | | the commission's Internet website[, if the commission makes |
|---|
| 38 | 38 | | statements filed under this subchapter available on its website]. |
|---|
| 39 | 39 | | SECTION 3. As soon as practicable after the effective date |
|---|
| 40 | 40 | | of this Act, the Texas Ethics Commission shall make the financial |
|---|
| 41 | 41 | | statements filed under Subchapter B, Chapter 572, Government Code, |
|---|
| 42 | 42 | | available on the commission's Internet website, as provided by the |
|---|
| 43 | 43 | | changes in law made by this Act. |
|---|
| 44 | 44 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 45 | 45 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 46 | 46 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 47 | 47 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 48 | 48 | | Act takes effect September 1, 2019. |
