55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the availability on the Internet of personal financial
88 statements filed by public officials.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 572.032(a) and (c), Government Code,
1111 are amended to read as follows:
1212 (a) Financial statements filed under this subchapter are
1313 public records. The commission shall maintain the statements in
1414 separate alphabetical files and in a manner that is accessible to
1515 the public during regular office hours and make the statements
1616 available to the public on the commission's Internet website.
1717 (c) After the second anniversary of the date the individual
1818 ceases to be a state officer, the commission may and on notification
1919 from the former state officer shall:
2020 (1) destroy each financial statement filed by the
2121 state officer; and
2222 (2) remove each financial statement filed by the state
2323 officer from the commission's Internet website.
2424 SECTION 2. Section 572.032(a-1), Government Code, as
2525 amended by Chapters 34 (S.B. 1576) and 983 (H.B. 776), Acts of the
2626 85th Legislature, Regular Session, 2017, is reenacted and amended
2727 to read as follows:
2828 (a-1) The commission shall remove the home address, the
2929 telephone number, and the names of the dependent children of an
3030 individual from a financial statement filed by the individual under
3131 this subchapter before:
3232 (1) permitting a member of the public to view the
3333 statement;
3434 (2) providing a copy of the statement to a member of
3535 the public; or
3636 (3) making the statement available to the public on
3737 the commission's Internet website[, if the commission makes
3838 statements filed under this subchapter available on its website].
3939 SECTION 3. As soon as practicable after the effective date
4040 of this Act, the Texas Ethics Commission shall make the financial
4141 statements filed under Subchapter B, Chapter 572, Government Code,
4242 available on the commission's Internet website, as provided by the
4343 changes in law made by this Act.
4444 SECTION 4. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2019.
