97 relating to reporting concerning certain prisoners who are confined
10- in county jails.

119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 511.0101, Government Code, is amended by
1311 amending Subsection (a) and adding Subsection (c) to read as
1412 follows:
1513 (a) Each county shall submit to the commission on or before
1614 the fifth day of each month a report containing the following
1715 information:
1816 (1) the number of prisoners confined in the county
1917 jail on the first day of the month, classified on the basis of the
2018 following categories:
2119 (A) total prisoners;
22- (B) pretrial Class C misdemeanor offenders,
23- categorized by sex, race or ethnicity, and age;
24- (C) pretrial Class A and B misdemeanor offenders,
25- categorized by sex, race or ethnicity, and age;
26- (D) convicted Class C misdemeanor offenders,
27- categorized by sex, race or ethnicity, and age;
20+ (B) pretrial Class C misdemeanor offenders;
21+ (C) pretrial Class A and B misdemeanor offenders;
22+ (D) convicted Class C misdemeanor offenders;
2823 (E) convicted Class A and B misdemeanor
29- offenders, categorized by sex, race or ethnicity, and age;
24+ offenders;
3025 (F) felony offenders whose penalty has been
31- reduced to a misdemeanor, categorized by sex, race or ethnicity,
32- and age;
33- (G) [(F)] pretrial felony offenders, categorized
34- by sex, race or ethnicity, and age;
35- (H) [(G)] convicted felony offenders,
36- categorized by sex, race or ethnicity, and age;
26+ reduced to a misdemeanor;
27+ (G) [(F)] pretrial felony offenders;
28+ (H) [(G)] convicted felony offenders;
3729 (I) [(H)] prisoners detained on bench warrants;
3830 (J) [(I)] prisoners detained for parole
3931 violations;
4032 (K) [(J)] prisoners detained for federal
4133 officers;
4234 (L) [(K)] prisoners awaiting transfer to the
4335 institutional division of the Texas Department of Criminal Justice
4436 following conviction of a felony or revocation of probation,
4537 parole, or release on mandatory supervision and for whom paperwork
4638 and processing required for transfer have been completed;
4739 (M) [(L)] prisoners detained after having been
4840 transferred from another jail and for whom the commission has made a
4941 payment under Subchapter F, Chapter 499[, Government Code];
5042 (N) [(M)] prisoners for whom an immigration
5143 detainer has been issued by United States Immigration and Customs
5244 Enforcement; and
5345 (O) [(N)] other prisoners;
5446 (2) the total capacity of the county jail on the first
5547 day of the month;
5648 (3) the total number of prisoners who were confined in
5749 the county jail during the preceding month, based on a count
5850 conducted on each day of that month, who were known or had been
5951 determined to be pregnant;
6052 (4) the total cost to the county during the preceding
6153 month of housing prisoners described by Subdivision (1)(N)
6254 [(1)(M)], calculated based on the average daily cost of housing a
6355 prisoner in the county jail; and
6456 (5) certification by the reporting official that the
6557 information in the report is accurate.
6658 (c) The commission shall make the information reported
6759 under Subsection (a) available on the commission's Internet
6860 website.
6961 SECTION 2. A county shall submit the first report required
7062 by Section 511.0101, Government Code, as amended by this Act, not
7163 later than October 5, 2019.
7264 SECTION 3. This Act takes effect September 1, 2019.
