8	6		AN ACT
9	7		relating to reporting concerning certain prisoners who are confined
10		-	in county jails.
	8	+	in county jails for misdemeanor offenses.
11	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	10		SECTION 1. Section 511.0101, Government Code, is amended by
13	11		amending Subsection (a) and adding Subsection (c) to read as
14	12		follows:
15	13		(a) Each county shall submit to the commission on or before
16	14		the fifth day of each month a report containing the following
17	15		information:
18	16		(1) the number of prisoners confined in the county
19	17		jail on the first day of the month, classified on the basis of the
20	18		following categories:
21	19		(A) total prisoners;
22		-	(B) pretrial Class C misdemeanor offenders,
23		-	categorized by sex, race or ethnicity, and age;
24		-	(C) pretrial Class A and B misdemeanor offenders,
25		-	categorized by sex, race or ethnicity, and age;
26		-	(D) convicted Class C misdemeanor offenders,
27		-	categorized by sex, race or ethnicity, and age;
	20	+	(B) pretrial Class C misdemeanor offenders;
	21	+	(C) pretrial Class A and B misdemeanor offenders;
	22	+	(D) convicted Class C misdemeanor offenders;
28	23		(E) convicted Class A and B misdemeanor
29		-	offenders~~, categorized by sex, race or ethnicity, and age~~;
	24	+	offenders;
30	25		(F) felony offenders whose penalty has been
31		-	reduced to a misdemeanor, categorized by sex, race or ethnicity,
32		-	and age;
33		-	(G) [(F)] pretrial felony offenders, categorized
34		-	by sex, race or ethnicity, and age;
35		-	(H) [(G)] convicted felony offenders,
36		-	categorized by sex, race or ethnicity, and age;
	26	+	reduced to a misdemeanor;
	27	+	(G) [(F)] pretrial felony offenders;
	28	+	(H) [(G)] convicted felony offenders;
37	29		(I) [(H)] prisoners detained on bench warrants;
38	30		(J) [(I)] prisoners detained for parole
39	31		violations;
40	32		(K) [(J)] prisoners detained for federal
41	33		officers;
42	34		(L) [(K)] prisoners awaiting transfer to the
43	35		institutional division of the Texas Department of Criminal Justice
44	36		following conviction of a felony or revocation of probation,
45	37		parole, or release on mandatory supervision and for whom paperwork
46	38		and processing required for transfer have been completed;
47	39		(M) [(L)] prisoners detained after having been
48	40		transferred from another jail and for whom the commission has made a
49	41		payment under Subchapter F, Chapter 499[, Government Code];
50	42		(N) [(M)] prisoners for whom an immigration
51	43		detainer has been issued by United States Immigration and Customs
52	44		Enforcement; and
53	45		(O) [(N)] other prisoners;
54	46		(2) the total capacity of the county jail on the first
55	47		day of the month;
56	48		(3) the total number of prisoners who were confined in
57	49		the county jail during the preceding month, based on a count
58	50		conducted on each day of that month, who were known or had been
59	51		determined to be pregnant;
60	52		(4) the total cost to the county during the preceding
61	53		month of housing prisoners described by Subdivision (1)(N)
62	54		[(1)(M)], calculated based on the average daily cost of housing a
63	55		prisoner in the county jail; and
64	56		(5) certification by the reporting official that the
65	57		information in the report is accurate.
66	58		(c) The commission shall make the information reported
67	59		under Subsection (a) available on the commission's Internet
68	60		website.
69	61		SECTION 2. A county shall submit the first report required
70	62		by Section 511.0101, Government Code, as amended by this Act, not
71	63		later than October 5, 2019.
72	64		SECTION 3. This Act takes effect September 1, 2019.
