66 AN ACT
77 relating to a fishing license fee waiver for certain veterans.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 46.004(b) and (c), Parks and Wildlife
1010 Code, are amended to read as follows:
1111 (b) The commission may establish a lower fee or waive the
1212 fee or license requirement for:
1313 (1) a resident who has a general commercial
1414 fisherman's license of this state;
1515 (2) a resident who is blind as defined by Section
1616 355.001 [94.001], Labor [Human Resources] Code;
1717 (3) a resident or nonresident who is under 17 years
1818 old; or
1919 (4) a resident or nonresident who is 65 years old or
2020 over.
2121 (c) The commission shall waive the fee for:
2222 (1) a qualified disabled veteran as defined by Section
2323 42.012;
2424 (2) a resident who:
2525 (A) served in the United States military forces;
2626 and
2727 (B) is 65 years old or over; and
2828 (3) [for] a resident on active duty as a member of the
2929 United States military forces, the Texas Army National Guard, the
3030 Texas Air National Guard, or the Texas State Guard.
3131 SECTION 2. (a) The change in law made by this Act applies
3232 only to a fee charged for a fishing license issued on or after the
3333 effective date of this Act.
3434 (b) A fishing license issued before the effective date of
3535 this Act is covered by the law in effect when the license was
3636 issued, and the former law is continued in effect for that purpose.
3737 The Parks and Wildlife Department is not required to issue a refund
3838 for any license issued before the effective date of this Act.
3939 SECTION 3. This Act takes effect September 1, 2019.
