7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 14 | | SECTION 1. Section 87.042, Local Government Code, is |
---|
9 | 15 | | amended to read as follows: |
---|
10 | 16 | | Sec. 87.042. COUNTY COMMISSIONER VACANCY. (a) Except as |
---|
11 | 17 | | provided by Subsection (b), if [If] a vacancy occurs in the office |
---|
12 | 18 | | of county commissioner, the county judge shall appoint a suitable |
---|
13 | 19 | | resident of the precinct in which the vacancy exists to fill the |
---|
14 | 20 | | vacancy until the next general election. |
---|
15 | 21 | | (b) This subsection applies only to a county with a |
---|
16 | 22 | | population of more than 300,000. Not later than the 60th day after |
---|
17 | 23 | | the date a vacancy occurs in the office of county commissioner, the |
---|
18 | 24 | | county judge shall appoint a suitable resident of the precinct in |
---|
19 | 25 | | which the vacancy exists to fill the vacancy until the next general |
---|
20 | 26 | | election. If the county judge does not make an appointment to fill |
---|
21 | 27 | | the vacancy before the 61st day after the date the vacancy occurred, |
---|
22 | 28 | | the commissioners court by majority vote shall appoint a suitable |
---|
23 | 29 | | resident of the precinct in which the vacancy exists to fill the |
---|
24 | 30 | | vacancy until the next general election. |
---|
25 | 31 | | SECTION 2. (a) Section 87.042, Local Government Code, as |
---|
26 | 32 | | amended by this Act, applies only to a vacancy in the office of |
---|
27 | 33 | | county commissioner that occurs on or after the effective date of |
---|
28 | 34 | | this Act. |
---|
29 | 35 | | (b) For a vacancy in the office of county commissioner that |
---|
30 | 36 | | occurred and has not been filled before the effective date of this |
---|
31 | 37 | | Act and to which Section 87.042(b), Local Government Code, as added |
---|
32 | 38 | | by this Act, applies: |
---|
33 | 39 | | (1) the county judge shall appoint, not later than the |
---|
34 | 40 | | 60th day after the effective date of this Act, a suitable resident |
---|
35 | 41 | | of the precinct in which the vacancy exists to fill the vacancy |
---|
36 | 42 | | until the next general election; and |
---|
37 | 43 | | (2) if the county judge does not make an appointment to |
---|
38 | 44 | | fill the vacancy before the 61st day after the effective date of |
---|
39 | 45 | | this Act, the commissioners court by majority vote shall appoint a |
---|
40 | 46 | | suitable resident of the precinct in which the vacancy exists to |
---|
41 | 47 | | fill the vacancy until the next general election. |
---|
42 | 48 | | SECTION 3. This Act takes effect immediately if it receives |
---|
43 | 49 | | a vote of two-thirds of all the members elected to each house, as |
---|
44 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
45 | 51 | | Act does not receive the vote necessary for immediate effect, this |
---|
46 | 52 | | Act takes effect September 1, 2019. |
