410 AN ACT
511 relating to the filling of a vacancy in the office of county
612 commissioner in certain counties.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 87.042, Local Government Code, is
915 amended to read as follows:
1016 Sec. 87.042. COUNTY COMMISSIONER VACANCY. (a) Except as
1117 provided by Subsection (b), if [If] a vacancy occurs in the office
1218 of county commissioner, the county judge shall appoint a suitable
1319 resident of the precinct in which the vacancy exists to fill the
1420 vacancy until the next general election.
1521 (b) This subsection applies only to a county with a
1622 population of more than 300,000. Not later than the 60th day after
1723 the date a vacancy occurs in the office of county commissioner, the
1824 county judge shall appoint a suitable resident of the precinct in
1925 which the vacancy exists to fill the vacancy until the next general
2026 election. If the county judge does not make an appointment to fill
2127 the vacancy before the 61st day after the date the vacancy occurred,
2228 the commissioners court by majority vote shall appoint a suitable
2329 resident of the precinct in which the vacancy exists to fill the
2430 vacancy until the next general election.
2531 SECTION 2. (a) Section 87.042, Local Government Code, as
2632 amended by this Act, applies only to a vacancy in the office of
2733 county commissioner that occurs on or after the effective date of
2834 this Act.
2935 (b) For a vacancy in the office of county commissioner that
3036 occurred and has not been filled before the effective date of this
3137 Act and to which Section 87.042(b), Local Government Code, as added
3238 by this Act, applies:
3339 (1) the county judge shall appoint, not later than the
3440 60th day after the effective date of this Act, a suitable resident
3541 of the precinct in which the vacancy exists to fill the vacancy
3642 until the next general election; and
3743 (2) if the county judge does not make an appointment to
3844 fill the vacancy before the 61st day after the effective date of
3945 this Act, the commissioners court by majority vote shall appoint a
4046 suitable resident of the precinct in which the vacancy exists to
4147 fill the vacancy until the next general election.
4248 SECTION 3. This Act takes effect immediately if it receives
4349 a vote of two-thirds of all the members elected to each house, as
4450 provided by Section 39, Article III, Texas Constitution. If this
4551 Act does not receive the vote necessary for immediate effect, this
4652 Act takes effect September 1, 2019.
