66 AN ACT
77 relating to the expiration date of a commercial driver's license;
88 increasing a fee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 522.029, Transportation Code, is amended
1111 by amending Subsection (a) and adding Subsection (m) to read as
1212 follows:
1313 (a) The fee for a commercial driver's license issued by the
1414 department is $96 [$60], except as provided by Subsections (f),
1515 (h), (j), [and] (k), and (m).
1616 (m) The fee for a commercial driver's license with a
1717 hazardous materials endorsement issued by the department is $60,
1818 except as provided by Subsections (h), (j), and (k).
1919 SECTION 2. Section 522.051, Transportation Code, is amended
2020 by amending Subsections (a), (b), (c), (d), and (f) and adding
2121 Subsections (i), (j), (k), and (l) to read as follows:
2222 (a) Except as provided by Subsections [Subsection] (f) and
2323 (i) and Sections 522.013(e), 522.033, and 522.054, an original
2424 commercial driver's license expires eight [five] years after the
2525 applicant's next birthday.
2626 (b) Except as provided by Subsection (j) and Section
2727 522.054, a commercial driver's license issued to a person holding a
2828 Texas Class A, B, C, or M license that would expire one year or more
2929 after the date of issuance of the commercial driver's license
3030 expires eight [five] years after the applicant's next birthday.
3131 (c) Except as provided by Subsection (k) and Section
3232 522.054, a commercial driver's license issued to a person holding a
3333 Texas Class A, B, C, or M license that would expire less than one
3434 year after the date of issuance of the commercial driver's license
3535 or that has been expired for less than one year expires eight [five]
3636 years after the expiration date shown on the Class A, B, C, or M
3737 license.
3838 (d) Except as provided by Subsection (l) and Section
3939 522.054, a commercial driver's license issued to a person holding a
4040 Texas Class A, B, C, or M license that has been expired for at least
4141 one year but not more than two years expires eight [five] years
4242 after the applicant's last birthday.
4343 (f) Except as provided by Section 522.013, a non-domiciled
4444 commercial driver's license other than a temporary non-domiciled
4545 commercial driver's license under Section 522.013(e) expires on:
4646 (1) the earlier of:
4747 (A) the first birthday of the license holder
4848 occurring after the eighth [fifth] anniversary of the date of the
4949 application; or
5050 (B) the expiration date of the license holder's
5151 lawful presence in the United States as determined by the
5252 appropriate United States agency in compliance with federal law; or
5353 (2) the first anniversary of the date of issuance, if
5454 there is no definitive expiration date for the applicant's
5555 authorized stay in the United States.
5656 (i) Except as provided by Subsection (f) and Sections
5757 522.013(e), 522.033, and 522.054, an original commercial driver's
5858 license with a hazardous materials endorsement expires five years
5959 after the applicant's next birthday.
6060 (j) Except as provided by Section 522.054, a commercial
6161 driver's license with a hazardous materials endorsement issued to a
6262 person holding a Texas Class A, B, C, or M license that would expire
6363 one year or more after the date of issuance of the commercial
6464 driver's license expires five years after the applicant's next
6565 birthday.
6666 (k) Except as provided by Section 522.054, a commercial
6767 driver's license with a hazardous materials endorsement issued to a
6868 person holding a Texas Class A, B, C, or M license that would expire
6969 less than one year after the date of issuance of the commercial
7070 driver's license or that has been expired for less than one year
7171 expires five years after the expiration date shown on the Class A,
7272 B, C, or M license.
7373 (l) Except as provided by Section 522.054, a commercial
7474 driver's license with a hazardous materials endorsement issued to a
7575 person holding a Texas Class A, B, C, or M license that has been
7676 expired for at least one year but not more than two years expires
7777 five years after the applicant's last birthday.
7878 SECTION 3. Section 522.052, Transportation Code, is amended
7979 by amending Subsections (b) and (c) and adding Subsections (k) and
8080 (l) to read as follows:
8181 (b) Except as provided by Section 522.054, a renewal of a
8282 commercial driver's license that has been expired for less than one
8383 year expires eight [five] years after the expiration date shown on
8484 the commercial driver's license.
8585 (c) Except as provided by Section 522.054, a renewal of a
8686 commercial driver's license that has been expired for at least one
8787 year but not more than two years expires seven [six] years after the
8888 applicant's last birthday.
8989 (k) Except as provided by Section 522.054, a renewal of a
9090 commercial driver's license with a hazardous materials endorsement
9191 that has been expired for less than one year expires five years
9292 after the expiration date shown on the commercial driver's license.
9393 (l) Except as provided by Section 522.054, a renewal of a
9494 commercial driver's license with a hazardous materials endorsement
9595 that has been expired for at least one year but not more than two
9696 years expires five years after the applicant's last birthday.
9797 SECTION 4. The changes in law made by this Act to Sections
9898 522.029, 522.051, and 522.052, Transportation Code, apply only to a
9999 commercial driver's license issued or renewed on or after June 1,
100100 2020. A commercial driver's license issued or renewed before June
101101 1, 2020, is governed by the law in effect immediately before the
102102 effective date of this Act, and the former law is continued in
103103 effect for that purpose.
104104 SECTION 5. This Act takes effect September 1, 2019.
