| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 981.004, Insurance Code, is amended by |
|---|
| 9 | 15 | | adding Subsection (e) to read as follows: |
|---|
| 10 | 16 | | (e) Notwithstanding Subsection (a)(1), the availability of |
|---|
| 11 | 17 | | windstorm and hail insurance from the Texas Windstorm Insurance |
|---|
| 12 | 18 | | Association does not preclude an eligible surplus lines insurer |
|---|
| 13 | 19 | | from providing windstorm and hail insurance under Subsection (a) or |
|---|
| 14 | 20 | | limiting the amount of insurance that may be provided under |
|---|
| 15 | 21 | | Subsection (b). |

| 16 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 17 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 18 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 19 | 25 | | Act does not receive the vote necessary for immediate effect, this |

| 20 | 26 | | Act takes effect September 1, 2019. |
