| 6 | 12 | | settlement and dispute resolution under the Texas Windstorm |

| 8 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 15 | | SECTION 1. Section 2210.581, Insurance Code, is amended by |
|---|
| 10 | 16 | | amending Subsections (a) and (b) and adding Subsection (d) to read |
|---|
| 11 | 17 | | as follows: |
|---|
| 12 | 18 | | (a) Subject to Subsection (b), the commissioner, on a |
|---|
| 13 | 19 | | showing of good cause, may by rule: |
|---|
| 14 | 20 | | (1) extend any deadline established under this |
|---|
| 15 | 21 | | subchapter; and |
|---|
| 16 | 22 | | (2) set the length of the extension. |
|---|
| 17 | 23 | | (b) With reference to deadlines applicable to the |
|---|
| 18 | 24 | | association only, all deadline extensions related to claims arising |
|---|
| 19 | 25 | | from [filed during] a particular storm [catastrophe year, the |
|---|
| 20 | 26 | | extension of deadlines under Subsection (a)] may not exceed 120 |
|---|
| 21 | 27 | | days in the aggregate. This subsection does not affect the |
|---|
| 22 | 28 | | extension of a deadline applicable to a claimant or to both the |
|---|
| 23 | 29 | | association and a claimant. |
|---|
| 24 | 30 | | (d) The commissioner shall adopt rules necessary to |
|---|
| 25 | 31 | | implement this section. Section 2001.0045, Government Code, does |
|---|
| 26 | 32 | | not apply to rules adopted under this subsection. |
|---|
| 27 | 33 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 28 | 34 | | to a claim filed on or after the effective date of this Act. A claim |
|---|
| 29 | 35 | | filed before the effective date of this Act is governed by the law |
|---|
| 30 | 36 | | applicable to the claim immediately before the effective date of |
|---|
| 31 | 37 | | this Act, and that law is continued in effect for that purpose. |

| 32 | 38 | | SECTION 3. This Act takes effect September 1, 2019. |
