A BILL TO BE ENTITLED
AN ACT
relating to carrying a handgun in certain areas of the campus of a
public or private institution of higher education.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 411.2031, Government Code, is amended by
adding Subsection (f) to read as follows:
(f) This section does not permit a license holder to possess
a concealed handgun, or go with a concealed handgun, on the premises
of a child-care facility, as defined by Section 42.002, Human
Resources Code, that is located on the campus of an institution of
higher education or private or independent institution of higher
education if the institution gives effective notice under Section
30.06, Penal Code.
SECTION 2. Section 46.03, Penal Code, is amended by adding
Subsection (j) to read as follows:
(j) Subsection (a)(1)(B) does not permit a person to possess
a concealed handgun, or go with a concealed handgun, on the premises
of a child-care facility, as defined by Section 42.002, Human
Resources Code, that is located on the campus of an institution of
higher education or private or independent institution of higher
education if the institution gives effective notice under Section
30.06.
SECTION 3. The change in law made by this Act applies only
to an offense committed on or after the effective date of this Act.
An offense committed before the effective date of this Act is
governed by the law in effect on the date the offense was committed,
and the former law is continued in effect for that purpose. For
purposes of this section, an offense was committed before the
effective date of this Act if any element of the offense occurred
before that date.
SECTION 4. This Act takes effect September 1, 2019.
