66 AN ACT
77 relating to state funding for the implementation of teacher
88 excellence initiative programs by school districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 21, Education Code, is
1111 amended by adding Section 21.358 to read as follows:
1212 Sec. 21.358. TEACHER EXCELLENCE INITIATIVE PROGRAM. (a)
1313 In this section, "teacher excellence initiative program" means a
1414 program implemented by a school district for:
1515 (1) evaluating the effectiveness of classroom
1616 teachers under a multi-measure system;
1717 (2) encouraging highly effective classroom teachers
1818 to remain at or seek transfer to campuses with poor overall or
1919 domain performance ratings under Section 39.054; and
2020 (3) awarding merit salary increases to classroom
2121 teachers based on the evaluation described by Subdivision (1) who
2222 are assigned to campuses described by Subdivision (2).
2323 (b) A school district may submit a request to the
2424 commissioner for state funding under this section to assist the
2525 district in providing the merit salary increases.
2626 (c) From funds appropriated for that purpose, the
2727 commissioner shall provide funding under this section in accordance
2828 with rules adopted by the commissioner for that purpose. If funds
2929 are not available to provide funding to each school district that
3030 submits a request under Subsection (b), the commissioner shall give
3131 priority to school districts with the highest proportion of
3232 educationally disadvantaged students.
3333 (d) Funding received under this section may only be used by
3434 a school district to provide and sustain merit salary increases
3535 provided to classroom teachers under a teacher excellence
3636 initiative program.
3737 (e) Rules adopted under Subsection (c) must require that a
3838 school district demonstrate improved campus performance in order to
3939 continue receiving merit salary increase funding for classroom
4040 teachers assigned to that campus.
4141 SECTION 2. As soon as practicable, the commissioner of
4242 education shall adopt rules under Section 21.358, Education Code,
4343 as added by this Act.
4444 SECTION 3. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2019.
