77 relating to community homes for persons with disabilities; creating
88 a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 123.002, Human Resources Code, is
1111 amended to read as follows:
1212 Sec. 123.002. DEFINITIONS [DEFINITION]. In this chapter:
1313 (1) "Community home" means a community-based
1414 residential home or assisted living facility that qualifies as a
1515 community home under Section 123.004.
1616 (2) "Person [, "person] with a disability" means a
1717 person whose ability to care for himself or herself, perform manual
1818 tasks, learn, work, walk, see, hear, speak, or breathe is
1919 substantially limited because the person has:
2020 (A) [(1)] an orthopedic, visual, speech, or
2121 hearing impairment;
2222 (B) [(2)] Alzheimer's disease;
2323 (C) [(3)] pre-senile dementia;
2424 (D) [(4)] cerebral palsy;
2525 (E) [(5)] epilepsy;
2626 (F) [(6)] muscular dystrophy;
2727 (G) [(7)] multiple sclerosis;
2828 (H) [(8)] cancer;
2929 (I) [(9)] heart disease;
3030 (J) [(10)] diabetes;
3131 (K) [(11)] an intellectual disability;
3232 (L) [(12)] autism; or
3333 (M) [(13)] mental illness.
3434 (3) "Property owners' association" and "restrictive
3535 covenant" have the meanings assigned by Section 202.001, Property
3636 Code.
3737 SECTION 2. Section 123.003(b), Human Resources Code, is
3838 amended to read as follows:
3939 (b) A restriction, reservation, exception, or other
4040 provision in an instrument created or amended on or after September
4141 1, 1985, that relates to the transfer, sale, lease, or use of
4242 property may not prohibit or effectively prohibit the use of the
4343 property as a community home.
4444 SECTION 3. Section 123.004, Human Resources Code, is
4545 amended to read as follows:
4646 Sec. 123.004. QUALIFICATION AS COMMUNITY HOME. To qualify
4747 as a community home, an entity must comply with Sections 123.005
4848 through 123.008 and be:
4949 (1) a community-based residential home operated by:
5050 (A) the Health and Human Services Commission
5151 [Department of Aging and Disability Services];
5252 (B) a community center organized under
5353 Subchapter A, Chapter 534, Health and Safety Code, that provides
5454 services to persons with disabilities;
5555 (C) an entity subject to the Texas Nonprofit
5656 Corporation Law as described by Section 1.008(d), Business
5757 Organizations Code; or
5858 (D) an entity certified by the Health and Human
5959 Services Commission [Department of Aging and Disability Services]
6060 as a provider under the ICF-IID medical assistance program; or
6161 (2) an assisted living facility licensed under Chapter
6262 247, Health and Safety Code, provided that the exterior structure
6363 retains compatibility with the surrounding residential dwellings.
6464 SECTION 4. Section 123.009, Human Resources Code, is
6565 amended to read as follows:
6666 Sec. 123.009. LIMITATION ON NUMBER OF MOTOR VEHICLES;
6767 OFFENSE. (a) Except as otherwise provided by municipal ordinance
6868 or by a restrictive covenant enforced by a property owners'
6969 association, the residents of a community home may not keep for the
7070 use of the residents of the home, either on the premises of the home
7171 or on a public right-of-way adjacent to the home, motor vehicles in
7272 numbers that exceed the number of bedrooms in the home as recorded
7373 in the appraisal records of the county in which the home is located.
7474 (b) A person commits an offense if the person keeps a motor
7575 vehicle in violation of Subsection (a).
7676 (c) An offense under this section is a Class B misdemeanor.
7777 (d) A motor vehicle kept in violation of Subsection (a) may
7878 be towed at the expense of the owner of the vehicle.
7979 SECTION 5. Section 123.010, Human Resources Code, is
8080 amended to read as follows:
8181 Sec. 123.010. ENSURING SAFETY OF RESIDENTS OF COMMUNITY
8282 HOME AND AFFECTED NEIGHBORHOOD. (a) The Health and Human Services
8383 Commission [Department of Aging and Disability Services] shall make
8484 every reasonable effort to ensure the safety of residents of a
8585 community home operated by or under the regulatory jurisdiction of
8686 the commission [department] and the residents of a neighborhood
8787 that is affected by the location of the community home.
8888 (b) A property owners' association or an affected property
8989 owner in a neighborhood in which a community home is located may
9090 report to an entity with regulatory jurisdiction over or that
9191 operates the home that the home:
9292 (1) has violated a provision of this chapter; or
9393 (2) poses a hazard to the safety or well-being of the
9494 neighborhood or community.
9595 (c) An entity that receives a report under Subsection (b)
9696 shall investigate the report in a timely manner and take
9797 appropriate action, including, as applicable, revocation of the
9898 entity's authorization to operate the community home.
9999 SECTION 6. Section 202.002(b), Property Code, is amended to
100100 read as follows:
101101 (b) This chapter does not affect the requirements of Chapter
102102 123, Human Resources Code [the Community Homes for Disabled Persons
103103 Location Act (Article 1011n, Vernon's Texas Civil Statutes)].
104104 SECTION 7. Section 202.003(b), Property Code, is amended to
105105 read as follows:
106106 (b) In this subsection, "community [family] home" has the
107107 meaning assigned by Section 123.002, Human Resources Code [is a
108108 residential home that meets the definition of and requirements
109109 applicable to a family home under the Community Homes for Disabled
110110 Persons Location Act (Article 1011n, Vernon's Texas Civil
111111 Statutes)]. A dedicatory instrument or restrictive covenant may
112112 not be construed to prevent the use of property as a community
113113 [family] home. However, any restrictive covenant that applies to
114114 property used as a community [family] home shall be liberally
115115 construed to give effect to its purposes and intent except to the
116116 extent that the construction would restrict the use as a community
117117 [family] home.
118118 SECTION 8. Chapter 202, Property Code, is amended by adding
119119 Section 202.0045 to read as follows:
120120 Sec. 202.0045. ENFORCEMENT OF RESTRICTIVE COVENANT ON
121121 PROPERTY USED AS COMMUNITY HOME. (a) A property owners'
122122 association may enforce a restrictive covenant that applies to
123123 property used as a community home, as defined by Section 123.002,
124124 Human Resources Code, to the same extent and in the same manner as
125125 the restrictive covenant is or would be enforced with respect to any
126126 other property that is subject to the restrictive covenant.
127127 (b) This section does not authorize a property owners'
128128 association to enforce a restriction that prohibits or effectively
129129 prohibits the use of property as a community home.
130130 SECTION 9. As soon as is practicable after the effective
131131 date of this Act, an entity with regulatory jurisdiction over a
132132 community home under Section 123.004, Human Resources Code, as
133133 amended by this Act, shall adopt the rules necessary to implement
134134 Section 123.010, Human Resources Code, as amended by this Act.
135135 SECTION 10. This Act takes effect September 1, 2019.
