86 AN ACT
97 relating to certain contract and notice requirements applicable to
108 certain facilities used to house inmates or releasees from the
119 Texas Department of Criminal Justice.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Section 493.010, Government Code, is amended to
1412 read as follows:
1513 Sec. 493.010. CONTRACTS FOR MISCELLANEOUS HOUSING. (a) The
1614 board, for the temporary or permanent housing of inmates, may enter
1715 into leases or contract with:
1816 (1) public or private jails; or
1917 (2) operators of alternative housing facilities.
2018 (b) The board may not enter into a lease or contract with an
21- operator of an alternative housing facility that is located in a
22- county with a population of 3.3 million or more unless the operator
23- submits to the board a permit or other documentation showing that
24- the facility is in compliance with all applicable municipal and
25- county regulations.
26- SECTION 2. Chapter 508, Government Code, is amended by
27- adding Subchapter E-1 to read as follows:
28- SUBCHAPTER E-1. ALTERNATIVE HOUSING IN CERTAIN COUNTIES
29- Sec. 508.171. APPLICABILITY. This subchapter applies only
30- with respect to alternative housing that is located in a county with
31- a population of 3.3 million or more.
32- Sec. 508.172. ALTERNATIVE HOUSING PROGRAM. The department
19+ operator of a private jail or alternative housing facility under
20+ Subsection (a) unless the operator submits to the board a permit or
21+ other documentation showing that the jail or facility is in
22+ compliance with all applicable municipal and county regulations.
23+ SECTION 2. Subchapter E, Chapter 508, Government Code, is
24+ amended by adding Sections 508.158 and 508.159 to read as follows:
25+ Sec. 508.158. ALTERNATIVE HOUSING PROGRAM. The department
3326 shall require that an applicant to participate as a provider in a
3427 program designed to provide alternative housing for two or more
3528 unrelated releasees submit with the application, in the manner
3629 specified by the department, a permit or other documentation
3730 showing that the proposed alternative housing facility is in
3831 compliance with all applicable municipal and county regulations.
39- Sec. 508.173. INFORMATION REGARDING ALTERNATIVE HOUSING;
32+ Sec. 508.159. INFORMATION REGARDING ALTERNATIVE HOUSING;
4033 NOTICE TO POLITICAL SUBDIVISION. (a) The department shall
4134 maintain the following information regarding releasees:
4235 (1) a list of facilities providing alternative housing
4336 to two or more unrelated releasees, including:
4437 (A) the name, address, and telephone number of
4538 the facility;
4639 (B) the county in which the facility is located;
4740 (C) information regarding whether the facility
4841 is in compliance with all applicable municipal and county
4942 regulations;
5043 (D) the number of releasees residing at the
5144 facility; and
5245 (E) the maximum capacity of the facility; and
5346 (2) a list of releasees being housed at a facility
5447 described by Subdivision (1), including:
5548 (A) the releasee's name;
5649 (B) the county in which the releasee is required
5750 to reside under Section 508.181;
5851 (C) the county in which the releasee committed
5952 the offense for which the releasee is on parole or mandatory
6053 supervision;
6154 (D) the alternative housing facility in which the
6255 releasee resides; and
6356 (E) the date on which the releasee began residing
6457 at the facility.
6558 (b) On request of a county or municipality, the department
6659 shall provide monthly the information maintained by the department
6760 under Subsection (a). A county or municipality shall notify the
6861 department if the county or municipality does not want to continue
6962 to receive the information.
7063 (c) The department shall provide the information to a county
7164 or municipality under Subsection (b) by secured electronic mail and
7265 in a machine-readable format.
7366 (d) On request by a member of the legislature, the
7467 department shall provide the information maintained by the
7568 department under Subsection (a) to the member.
7669 SECTION 3. (a) Section 493.010, Government Code, as
7770 amended by this Act, applies only to a lease or contract entered
7871 into on or after the effective date of this Act.
79- (b) Section 508.172, Government Code, as added by this Act,
72+ (b) Section 508.158, Government Code, as added by this Act,
8073 applies only to an application to participate in a program
8174 described by that section that is submitted on or after the
8275 effective date of this Act.
8376 SECTION 4. This Act takes effect September 1, 2019.
