88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The heading to Title 9, Business & Commerce Code,
1010 is amended to read as follows:
1111 TITLE 9. APPLICABILITY OF LAW TO COMMERCIAL TRANSACTIONS AND OTHER
1212 CONTRACTS
1313 SECTION 2. Title 9, Business & Commerce Code, is amended by
1414 adding Chapter 275 to read as follows:
1515 CHAPTER 275. STATE LAW CONTROLS OVER CONFLICTING CONTRACT TERMS
1616 Sec. 275.001. CONFLICT WITH STATE LAW. (a) To the extent a
1717 term or condition of a contract is in conflict with a law of this
1818 state, the law of this state controls.
1919 (b) Subsection (a) may not be construed to authorize the
2020 impairment of any contract in violation of the Texas Constitution
2121 or the United States Constitution.
2222 SECTION 3. This Act takes effect September 1, 2019.
