| 7 | 7 | | relating to the transportation or storage of a firearm or |

| 8 | 8 | | ammunition by a handgun license holder in a private school parking |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 37.0815(a), Education Code, is amended |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | (a) A school district, [or] open-enrollment charter school, |
|---|
| 14 | 14 | | or private school, including a parochial school, may not prohibit a |
|---|
| 15 | 15 | | person, including a school employee, who holds a license to carry a |
|---|
| 16 | 16 | | handgun under Subchapter H, Chapter 411, Government Code, from |
|---|
| 17 | 17 | | transporting or storing a handgun or other firearm or ammunition in |
|---|
| 18 | 18 | | a locked, privately owned or leased motor vehicle in a parking lot, |
|---|
| 19 | 19 | | parking garage, or other parking area provided by the district, |
|---|
| 20 | 20 | | [or] charter school, or private school, provided that the handgun, |
|---|
| 21 | 21 | | firearm, or ammunition is not in plain view. |

| 22 | 22 | | SECTION 2. This Act applies beginning with the 2019-2020 |
|---|
| 23 | 23 | | school year. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2019. |
