55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to contested case hearings conducted on behalf of the
88 Texas Commission on Environmental Quality on matters involving
99 municipal solid waste permits.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2003.047, Government Code, is amended by
1212 adding Subsections (d-1) and (l-1) to read as follows:
1313 (d-1) For the purposes of Subsection (d), to be eligible to
1414 preside at a hearing related to a permit for a municipal solid waste
1515 facility, an administrative law judge must have experience with
1616 solid waste engineering or management.
1717 (l-1) For a hearing related to a permit for a municipal
1818 solid waste facility, the administrative law judge shall:
1919 (1) present the findings of fact, conclusions of law,
2020 and any ultimate findings under Subsection (l) at an open meeting of
2121 the commission; and
2222 (2) answer questions related to the findings and
2323 conclusions asked by the commissioners.
2424 SECTION 2. The changes in law made by this Act apply only to
2525 a contested case hearing related to a permit for a municipal solid
2626 waste facility that is set by the State Office of Administrative
2727 Hearings on or after the effective date of this Act. A hearing set
2828 before the effective date of this Act, or any decision issued or
2929 appealed from the hearing, is governed by the law in effect when the
3030 hearing was set, and the former law is continued in effect for that
3131 purpose.
3232 SECTION 3. This Act takes effect September 1, 2019.
