7 | 7 | | relating to contested case hearings conducted on behalf of the |

8 | 8 | | Texas Commission on Environmental Quality on matters involving |
---|
9 | 9 | | municipal solid waste permits. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 2003.047, Government Code, is amended by |
---|
12 | 12 | | adding Subsections (d-1) and (l-1) to read as follows: |

13 | 13 | | (d-1) For the purposes of Subsection (d), to be eligible to |
---|
14 | 14 | | preside at a hearing related to a permit for a municipal solid waste |
---|
15 | 15 | | facility, an administrative law judge must have experience with |
---|
16 | 16 | | solid waste engineering or management. |
---|
17 | 17 | | (l-1) For a hearing related to a permit for a municipal |
---|
18 | 18 | | solid waste facility, the administrative law judge shall: |
---|
19 | 19 | | (1) present the findings of fact, conclusions of law, |
---|
20 | 20 | | and any ultimate findings under Subsection (l) at an open meeting of |
---|
21 | 21 | | the commission; and |
---|
22 | 22 | | (2) answer questions related to the findings and |
---|
23 | 23 | | conclusions asked by the commissioners. |
---|
24 | 24 | | SECTION 2. The changes in law made by this Act apply only to |
---|
25 | 25 | | a contested case hearing related to a permit for a municipal solid |
---|
26 | 26 | | waste facility that is set by the State Office of Administrative |
---|
27 | 27 | | Hearings on or after the effective date of this Act. A hearing set |
---|
28 | 28 | | before the effective date of this Act, or any decision issued or |
---|
29 | 29 | | appealed from the hearing, is governed by the law in effect when the |
---|
30 | 30 | | hearing was set, and the former law is continued in effect for that |
---|
31 | 31 | | purpose. |
---|
32 | 32 | | SECTION 3. This Act takes effect September 1, 2019. |
