9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to the system by which an application for a low income
612 housing tax credit is scored.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 2306.6710, Government Code, is amended
915 by adding Subsection (g) to read as follows:
1016 (g) If no written statement is received for an application
1117 under Subsection (b)(1)(J), the department shall use the maximum
1218 number of points that could have been awarded under that paragraph
1319 to increase the maximum number of points that may be awarded for
1420 that application under Subsection (b)(1)(B). If awarding points
1521 under Subsection (b)(1)(B)(iii), the department shall reallocate
1622 the points from the scoring category provided by Subsection
1723 (b)(1)(J) equally between the political subdivisions described by
1824 Subsection (b)(1)(B)(iii). In awarding points transferred under
1925 this subsection from the scoring category provided by Subsection
2026 (b)(1)(J) to the scoring category provided by Subsection (b)(1)(B),
2127 the department shall award:
2228 (1) positive points for positive resolutions adopted;
2329 (2) negative points for negative resolutions adopted;
2430 and
2531 (3) zero points for neutral resolutions adopted.
2632 SECTION 2. The change in law made by this Act applies only
2733 to an application for low income housing tax credits that is
2834 submitted to the Texas Department of Housing and Community Affairs
2935 during an application cycle that is based on the 2020 qualified
3036 allocation plan or a subsequent plan adopted by the governing board
3137 of the department. An application that is submitted during an
3238 application cycle that is based on an earlier qualified allocation
3339 plan is governed by the law in effect on the date the application
3440 cycle began, and the former law is continued in effect for that
3541 purpose.
3642 SECTION 3. This Act takes effect September 1, 2019.
